I'm officially a US Citizen!!! Thank you VJ guys :)

Hello everyone, I arrived at the DHS in Charlotte,NC at 12:05pm. My appointment for my Oath Ceremony was scheduled for 12:30 pm. Their were 88 people from 44 different countries taking the Oath today. I'm very proud to tell you all " I'm a United States Citizen " I wish everyone the very best on your continued journey. Had my interview today.

Passed test but then IO started grilling me about my marriage, asking to withdraw petition which i couldnt without my lawyer. After 50 min or so of grilling i got RFE!

Sorry to hear this, spring333. I am thinking you are applying under the 3-year rule, is that correct?

Did the IO tell you why he recommends that you withdraw the petition? What was the RFE?

Now I am getting nervous too :(

Yes, under 3 year rule

Well bunch of things:

` lease for my spouse for the time before we met?!?!

` W2 for last 4 years which i gave him from our tax forms

` IRS transcripts although we sent copies from past 4 years

`corespodence with social sec office or public benefit agencies - whatever that is

` letters from empoyers from 2012 till today about salary and hours

` student records for both of us from 2012

` certified copies of ID

` police and court records

` pix

` phone listing for past 4 years....

Some of those I had with me so i gave them. i dont see why do they need letters from empoyers as you can see all names and salary in W2 forms right and all is provided...

I think i might take a lawyer now

I agree with you, W2 carried all the information and is a better document than "letters".

Obviously, an approval would have been better, but let's keep things in perspective:

- you weren't denied

- you were told what they want rather than sent home to wait for a decision or to find out if there'll be an RFE.

Since they are looking for specific things, rather than a vague request to convince them, then you know what to do.

It's a good sign, I think, that they've asked for this... it means (again, I think) that submitting the requested info should lead to approval.

One tip... include copies of whatever you gave them today with your RFE response. For example, if you gave them the W2s, send in copies of those same W2s... when they get your response, there's a chance that they'll just look at what you sent and not bother looking through the rest of your file right away... this could lead to a delay.

I agree... the tax returns would carry employment information, wages, w2s.

Had my interview today.

This is the second time a December marriage-based applicant has been asked to withdraw their petition. Over the past few months, several immigration websites have reported that USCIS has been cracking down on marriage fraud... actually, maybe since the beginning of last year.

There were two cases (that I read) here on VJ where USCIS contacted the applicant's ex-wife (once in person at her home and once by phone) after the interview. There was one case I remember where the applicant was asked why her husband wasn't with her (he was at work) and asked to speak to the husband on the phone during the interview. In all three cases the applicants were approved eventually (if I remember correctly), but these were somewhat unusual experiences. So it's clear that USCIS has been, in some cases, putting more effort into investigating marriage-based applications (or 5 year applications stemming from marriage-based green cards). Perhaps the request to withdraw the application is a new tactic to help relieve the pressure? Maybe they think that if an applicant thinks they don't have a strong case they'll just go away? I'm just guessing here...

It's noteworthy though, that both our December applicants who were told to withdraw their applications were not denied at the end of the interview.

Ill collect as much as I can and send. even if they deny it after it, i can apply again in 5 years, that will come sooner or later. they just make this more complicated from some reason
