N-400 December 2015 Filers

Timeline

For what it's worth, I have two speeding tickets and one parking ticket on my record.

I have court dispositions (direct letter from the court for one, e-payment receipt and response from court for the other) and proof of payments (debit card statements with the payment highlighted) for both speeding tickets, and I have proof of payment for the parking ticket (credit card statement with the payment highlighted). I don't think I can get the court disposition for the parking ticket because I have no idea what the ticket number is, and also it was in 2009, so I'm just hoping proof of payment is enough.

Oh, I also have my driver's abstract from both states where I've lived. Not sure if I should bother getting my Ontario driver's abstract.

Well, the N-400 instructions state:

You do not need to bring documentation for traffic fines and incidents (unless alcohol- or drug-related) that did not involve an actual arrest if the penalty was only a fine of less than $500 or points on your driver's license.

So you can call it paranoia if you want. I have heard of people being asked for proof that they paid them off, so I'm just covering my bases.

The speeding ticket thing comes up almost every month.

Some interviewers make a big deal out if it, some don't.

If you have records of payment, take them with you.

If you don't, then at least request your driving record (in almost all states, it won't have all your citations on it). This may or may not be enough for the interviewer.

You can also call the court in question or write to them and request a copy of your disposition. Some courts have online records now.

Really, it all depends on how hard-nosed the interviewer wants to be. The application asks you to list all citations, but they are not supposed to ask to see any evidence of anything under a $500 fine as long as it's not DWI/DUI related. However, they often ask anyway and some people have been sent home with a decision pending until they sent in a court disposition. Others were flat out told that they needn't even list traffic incidents.

So my advice is, take as much evidence as you can reasonably get... if it's going to be a major pain, just go to the interview, and see what the interviewer asks for... chances are they won't care. If they insist on evidence, you can deal with that at that time. Of course, if you can, it's better to have everything ready before hand.

I just realized yesterday that I messed up with my application as well. Only mine is worse than just tickets. I didn't write down all the names that "I've used". I came to the US on a student visa, I had a passport in my maiden name, visa in my maiden name. All official documents were in that name. But there was another letter to the Social Security Officer with an explanation that I came with that visa and need a SSN with restrictions or something like that. That letter was translated from Russian language word-to-word and it had my name like "last name - first name - patronym / partonimic name as a middle name". That's how we use names in Russia (and many other Slavic and Asian countries as well) but patronym isn't a middle name. So long after that, after I met my husband and got married and we applied to change my status I went to SS administration with my husband and all my documents & marriage license and explained to the officer that name on my card was incorrect according to US standards. We even printed out a few articles explaining what patronym means in English. We lived in NYC at that time and most of the official workers there were used to different cultures and languages so they accepted my documents and changed my name without a problem. All of my credit cards, college documents, lease documents were only in my maiden name and my name after marriage. I never had any other documents with that patronym except for that SSN card I later changed. So I never considered that "I used" that name. But now I'm afraid that can cause a problem with my application and a background check. As far as I remember we didn't put that patronym on my green card application as well and our IO didn't ask about that either. But naturalization process is more serious (((((( What should I do?! Schedule an Info Pass to correct it or just wait and explain that situation to my IO at the interview?!?

I honestly wouldn't worry too much about it because you never actually used that name. Have you already had your Biometrics captured? The form that they ask you to fill out at your appointment asks for aliases so you can add it there. The IO who interviewed me also asked me again about any names I've used. Call USCIS and see what they say and you can always schedule an Infopass just to be safe. :)

I hope they can give you some helpful info! Just remember to bring all your IDs since you came to the U.S. to show the IO who interviews you that you've never used that name and that you corrected it at the SSA as soon as you noticed - bring the documents you have regarding patronym as well. Just be truthful and I doubt it would cause any problems! :) It was an honest mistake (it was really an error on the SSA's part and not yours at all)!

Ok, so I called USCIS and asked the question about patronym. The lady on the phone said it won't be a problem. If during my background check USCIS will find out about that name and there will be something significant they will contact me to ask for extra documents. If they won't contact me then everything is Ok. But I will bring some info about patronymic names to the interview.

Cool, now I don't need to worry about that Bananezorro.gif and I can start worrying why didn't I get an "in line" notice 4fvfcja.gif

Just called USCIS and was like a bull in a china shop...the lackey on the phone wouldn't transfer me over to an IO but I pushed like my life depending on it.

Interview date is set for March 8th at 10:45 am....WOW this is it!!
