I am pissed beyond words............. I will post here in hopes of getting some answers soon rather than in the Off Topic area

I am sure others have run into this problem. How do you go about getting a State I.D. or a Driver License if your I-94 expires in less than 30 days.

I cannot believe that if it is less than 30 days they won't give you one. Whats the deal... I could understand if it was expired.

Also once the K-1 visa has expired, and of course we have married in the time given and filed the AOS, what documentation can my fiance carry stating that she is legal in this country while the AOS is being processed

HELP PEOPLE.... before I stroke out here...

She need to license to buy her car this week that we have a deposit on.

6/02/06 - Receive notice that AOS only has been transferred to California to speed things along

6/07/06 - E-mail that AOS received in California

6/13/06 - Welcome letter mailed by California... yeah baby

6/17/06 - Official welcome letter received and card will arrive within 3 weeks

6/19/06 - Card arrived in the mail.......

3/08/07 - Trip back to Peru for 10 days and our Religous Wedding

3/2007 - We're Pregnant

12/19/07 - Sebastien Joshua born 8:29am 7lbs 2oz 19.5"

3/14/08 - I-751 Removing Condition is in the mail

3/20/08 - Checked cashed

3/17/08 - I-751 Package signed and received

3/24/08 - Case moved to Vermont

4/17/08 - Biometrics completed

4/21/08 - Touched...........

6/16/08 - Touched once again........

11/3/08 - Touched again.. this is begining to feel good

When I got my driver's license (in AZ) they wanted my I-797 from my I-485. That way they know you're in AOS.

October 19, 2006 2nd Immigration Interview - APPROVED

5-20 business days for the Green Card to arrive, maybe I'll be back to see my family before Christmas?

She will have to wait until she has her EAD to get SSN and State ID/DL until then all she can do is use her passport as ID and when you receive NOA for AOS she can carry a photocopy of that in her passport.....

I got the runaround on this. It seems to depend on the office you have. The I-797 receipt for the AOS is really the only proof that you can get that you're in "process" and I know that when I asked the state of Illinois, they were pretty much unimpressed. You can have your EAD/SSN for that, but it'd expire as soon as the EAD was done.

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!
19 July 2005 - NOA 1: I-130 received!
24 August 2005 - Biometrics appointment (Naperville, IL).
25 August 2005 - AOS touched.
29 August 2005 - AP, EAD, I-485 touched.
15 September 2005 - AP and EAD approved!
03 February 2006 - SSN arrives (150 days later)
27 February 2006 - NOA 2: Interview for 27 April!!
27 April 2006 - AOS Interview, approved after 10 minutes!
19 May 2006 - 2 year conditional green card.
01 May 2008 - 10 year green card arrives.
09 December 2012 - Assembled N-400 package.
15 January 2013 - Sent package off to Phoenix.

DLs/ID cards can differ a lot by state. Are you in California?

We are in CA and got ID card only after getting EAD. But, ID card was good for the regular 5 years. (Others have posted that their IDs/DLs were only good until their legal presence document expiration date.) Then when we went to get DL a few years later, they did not check for another legal presence document and just issued the DL based on the ID card.

I think it can vary depending on which office you go to also. They don't all know the rules and/or rules are interpreted differently at each office. For us, it was easier dealing with the small office in So. Lake Tahoe than the larger office in the SF Bay Area.

As for what to use to prove legal presence while AOS is processing -- we found the best document to use was the EAD, it seemed to be universally recognized by all government and other agencies. Carrying the NOA should work in theory too but in reality it's a bit more difficult to get people to accept.

What makes me even more angry is that on the Florida DMV web sight it states that she need to bring her

I-94 form but does not state that that it has to be within 30 days of expiration. So I lost an afternoon of work, driving to hell and gone only to have this happen.

Oh well, better days are coming

Georgia does not even accept that. You can use your EAD And SSN to get a drivers license in georgia.

Feb 2005 - APPROVED for K1 Visa

June - 2005 - Moved to the USA =)

Apr - 2006 - APPROVED AOS Without Interview!!

Feb - 2008 - REMOVAL of conditions!!!!!

02/20/2008 - Package was sent to TSC.

02/25/2008 - Package confirmed received at TSC.

Hi there! Im sorry to hear your problem bec. you said that you live here in florida and same with me too.Just bring your passport,marriage certificate,SSN and impt. your latest NOA's from your I-765 and I-485(I-797).First time went to florida dmv with my husband took 2hours off just to accompany but nothing happened i forgot to bring my I-485&I-765 noa's.After 2 days last Feb.8 went back again alone riding my bike dmv office is just 10mins. away from our house brought my uscis papers i waited for 20 mins, standing in front of the officer and keep praying they will allow me to take the exam so they did got my learner's permit in that day.I recieved the actual card permit after 3 weeks.I scheduled my road test on friday at 34th St. dmv office gainesville,FL.

Same here in Alabama. I am going Friday to change my drivers over. They told me I needed my EAD and SSN. We jsut got our EAd card so now I can finally have a Alabama drivers lisense. :yes:

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

What actually has surprised me is that the Driver license card is given to you on the spot! :o I remember waiting 2 weeks to get my drivers license card in the mail!
