Hey guys,

So I have another situation I have questions about. As of now, I live at home with my parents. My parents are divorced and I go between houses, but I mainly spend time at my mom's house only because it is closer to my college (I commute). I lived with my dad during high school and just graduated this year, meaning my license and all that was registered to my dad's. I was prepping a bit early for packet 3 and I saw that one had to establish their domicile. The thing is though, my important documents are split between my parents. For example, my driver's license, passport, financial aid, car insurance, and health insurance is with my father. My tax returns go to my mother and she holds the title for my car. On the I-129F, I listed that my fiance will be living with my mom, but the return address for any documents that USCIS will send to my house was to my dad's. Will the Montreal embassy have a problem with this? I can prove I live with both parents if I really wanted to. If this is a problem, what should I do?

Also, I have never been in the military, never commited a crime, have never been married, adopted, etc. Do I need to supply any of this stuff if I've never participated in any of these things? I know I need to get a police certificate and that's the only thing I know that I can provide.

Anything you've never done, you don't supply documents because you don't have them to supply. Just do the police clearance and you'll be fine.


As for the proof of domicile, recently Montreal hasn't been taking it. I sent my fiance LOADS of proof of domicile and they didn't even take a piece of it. Recent reviews haven't listed it as being taken either, but always take just in case.

Personally though, which ever house has the "best" proof. I would go with that one. Being between two houses constantly isn't really that stable and showing you're constantly here or there might not look that great. From what you said, your dad's house seems to have the best "proof" of you living there, based on what you said was listed under that address.

Will your fiance be moving around with you between houses? Is there any reason that you spend half the week in one place and half in the other (meaning you're 18 and can technically choose to stay put in one place, there's no reason for sharing anymore other than if you enjoy it)?

If you plan on staying with your mom more of the time, you need to change all of the documents to reflect this. In the future with AOSing, you don't want any proof you might have to be all over the board.

As an adult you can't really have two primary residences. You need to pick one. You can't be in two locations at once. You need to get all of your addresses for what you will consider your PRIMARY residence, if that's your mom's house, then your dad's house is just you visiting him, but you need to have all of your stuff under one address.

It shouldn't be that much of an issue, don't tell more than asked. I personally wouldn't mention the possibility of him jumping around between two houses every few days, as that's not really considered stable.

the reason why I go between two houses is because it's my mom and dad. I love both of them dearly and this is how it has always been since my parents divorced (since I've been 12). When Jacobe visited, I still followed my schedule of going between mom and dad. My mom and dad have a good relationship and both of them decided that my financial aid should be with my dad, even though because of college I spend most of my week at mom's (Monday-Thursday). Friday through Sunday I'm with my dad. I can't exactly change my information for financial aid because my mom is married to someone who makes more than the average man (trucking company, over 6 digits grossed in one year, but most of it is not pocketed). My parents are making me pay for my education and I need all the help I can get, so it helps that it's almost evenly split when it comes to going between mom and dad. Would it just be easier to say that Jacobe will be living with my dad? My mom is going to be his cosponsor though because of the whole thing of not being able to provide 3 tax returns.

So for how long will you go between houses? Won't it be odd moving back and forth with your husband?

I guess i'll go a week or two between houses now and not necessarily. He actually enjoyed going back and forth between my parents when he came down here to visit.

Just remember for future steps to at least have the same address. Don't put him down at one place and you at another. If this is how you will be living I guess none of you are on any utility bills so make sure you open up joint accounts and such.

You're more likely to hit a road bump when you try to AOS after you get married than in Montreal at the moment simply because they aren't asking for proof of domicile at the counter at the interviews at the moment. You could hit a bump if your fiance openly says he'll be living here for 3 days and there for four, or here for two weeks and there for another two.

But I also don't think that you're going to want to put him at two places either. Proof of bona fide marriage tends to lean a lot of commingling of things. Having a lease or rental contract together, insurance in both your names and same location, joint bank accounts, etc. At the moment, your husband will be on car insurance that has your fathers address, but when you file taxes if you file jointly, it'll say he lives at your mom's house. Both of these things you would provide them for AOS or at the very least the interview itself.

The government doesn't really like situations that seem odd or isn't the "normal" thing to do. They aren't likely to understand that you still split your time between your parents after you hit 18 and are planning to get married and live the "normal" married life, and that you're using different addresses and haven't settled for one primary residence.

You'll want to get any proof you send them to all have the same address. This is a paperwork issue.

If the car is in your mom's name then the car is irrelevant as it's not technically owned by you, is the car registered to you? If not, then again, your mom holding the title is irrelevant. What address does your bank account have?

Get your W2's and taxes put in your dad's address. You have a stronger case that you "live" at your dad's house since your car insurance, drivers lisense, and health insurance all say you do.

My bank account is linked to my mom's address. I can switch that over.

Are you the petitioner? If so you dont need a police certificate. All of that is for thr beneficiary. Who does not need to prove domicile.

Domicile is only an issue if the petitioner was not living in the USA.

Domicile is only an issue if the petitioner was not living in the USA.

The proof of domicille worry was just because it's listed in the packet 4 things you need for K1 without any context. Up until the last few months they had been asking it of people, but not since then, so it's a hit or miss if they'll actually ask.

I think she's the beneficiary?

Also agreeing about the visiting is different from living!

But yeah with her being the beneficiary, eventually adding her husband onto things with different addresses, that's just no good for AOS.

Well the petitioner doesnt need a police certificate etc.. the beneficiary needs those things. The P3 is for the beneficiary not petitioner except the I-134. So her fiancé needs to get his police certificate etc... the only extra item (beyond the I-134) needed from a K1 petitioner is an original divorce decree.
