Hi all, I just have a few questions regarding the Affidavit of Support as we go through the AOS paperwork. We are using my Wife's mother as a joint sponsor and we all live at the same address currently, I'm pretty sure I have all this right, I just wanted to check with you fine people that I am doing it correct...

1) My wife still has to fill in an I-864, with supporting documents. Just checking?

2) Part 5 of my wife's Affidavit, (sponsors household) Question 7.OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here.

Now, if we are using a joint sponsor do we include her mother here? Since we are not combining incomes (her Mother makes more than enough to cover me) I assume that we leave this as zero since we are filling out a I-864 for her mother anyway?

3) Now onto my Mother-In-Law's I-864. Her and her husband File Taxes jointly, so when it comes to (sponsors household) Question 7.OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here. I'm guessing we put a 1 (Her Husband) and have him fill out a I-864A? Despite her earning over the Poverty Guidelines on her own, we still have to add him in?

That's all the questions I have right now. Thanks to anybody who can help!

Yes, you have it right.

Your wife is only required to send her most recent tax return with it.

You could use the option to put the parents on the wife's form but it gets messy. Separate for the Mom is better.

Theoretically you can prove the Mom's separate income with additional documentation (employer letter, pay slips) and she would not have to add Dad. That's because their joint tax return is not broken down into who earns how much.It's all lumped together if you only send a tax return. USCIS has no way of knowing mom's separate income qualifies. People don't understand that and get an RFE saying mom doesn't make enough. In reality the RFE is because Mom didn't prove her separate income. Don't forget the parents have to prove they are USCs or permanent residents (photocopy of birth certificate, passport, or greencard)

Could I include the same letter from employer I brought to my K-1 interview with the supporting documents for the mother's affidavit? Or do you recommend getting a new one?

If it's the original letter, not a photocopy. Letter type things ought to be originals, however sometime people just print an employment verification off the internet and those work as well. Just saying if it was me, I would use an original if it's signed. And I did use the same letter from the K1 interview for AOS because they handed it back.
