Hi! Can anyone please give me some advice on what to do. We received the RFE letter stating that my husband (petitioner) doesn't meet the minimum income requirements which we will end up getting a joint sponsor. Then, there's also another box marked x saying that the petitioner need to send a copy of the recent federal tax return, at the end of it there's 2014 written. I think this one is my fault, we sent the tax return transcript for the year 2012 and 2013 but we didn't have one for 2014 and I thought w2s would be enough instead of sending the whole tax paper work from H&R block. But my main question is my joint sponsor is married and been filling her taxes jointly for the last three recent years, although on year 2012 and 2013 most of their income comes from her husband but the year 2014 is mostly from her since her husband got no job until now, do we need to send her w2s or do we have to have her husband file I864a? Also, do we have to file 2 forms of I864 one for my husband the petitioner and one for my joint sponsor? Please I really do need some advice

Hey. I was in the same situation. I send the transcripts of joint sponsor and the w2. He also wrote a letter explaining that we did not want to count his wife income and that they should acceot the value on his w2 as his income. Now, we send the response 2 weeks ago so I did not have an answer yet. In my opinion if the joint sponsor spouse is working, even if not making too much money, is just easier to have them file the i-864a and not have to worry about an acceptable way to proof individual income. Also, dont forget to send the tax transcripts, pay stubs, birth certificates and w2 or 1099. If you did not send the tax transcript for your husband for 2014, add that to the pack, he is your main sponsor and even if he doesnt make enough they want to see his whole paperwork!

Hi there! Thank you for your response. But my joint sponsor's spouse is currently no job since 2014 until now, should we still let him file the i864a? And according to the RFE letter they only mention about my husband/petitioner recent federal tax return specifically the year 2014, does that mean we only need to send just that or should we also send another form I864 on his name and all the evidences that we sent before?

I think just like mine, if the joint sponsor spouse is not working then no need to fill i-864a. Just make sure you explain you are counting only the income from joint sponsor. I think the tax transcript dfor you husband can be send without a new form, just explain in the cover letter that you are sending as what was missing from main sponsor tax return.
