Here is how I understand it, on form I-485 when they ask about evidence of eligibility, they specify cases:

"Evidence of eligibility.

------Based on an immigrant petition.

Attach a copy of the approval notice for an immigrantpetition that makes a visa number immediatelyavailable to you, or submit a complete relative, specialimmigrant juvenile, or special immigrant militarypetition which, if approved, will make a visa numberimmediately available to you.

------Based on admission as the K-1 fiancé(e) of a U. S.citizen and subsequent marriage to that citizen.

Attach a copy of the fiancé(e) petition approvalnotice, a copy of your marriage certificate and your Form 1-94.

etc. "

So - when your case is second you should submit marriage certificate twice, but if your case is first they don't ask for marriage certificate but for I-130 which can be submited concurrently.

That is the same way I read the instructions, but I guess we will know more once I get my RFE in the mail.

July 12, 2006 - APPROVED!!!!

August 14, 2006 - Welcome to the US letter and I-130 approval received in the mail

August 15, 2006 - Permanent Resident Card received in the mail

Could you please tell us if RFE was connected with marriage certificate? I wonder about that.

Old link, but I'm going to reply, because I did a search, found this thread and wish I'd found it sooner. We submitted an I-130 and an I-485 together. Under the evidence section of the I-485 discussed in this thread, we thought the I-130 to which we attached both the birth cert of the US Citizen (me) and our marriage certificate was enough to provide evidence for both. It wasn't. We just got an RFE related to the I-485 asking for one copy of each.

If you submit an I-130 and I-1485 together because you are a US citizen petitioning for an alien to get a creen card, you will need to submit one copy of the US birth certificate and Marriage license with EACH form to prove both the relationship and that one person is a US Citizen. So 2 total copies of each.

4/25 - overnighted packet to Chicago (130, 485, 765, 131)

5/01 - NOA date

5/18 - RFE received for 485

5/19 - biometrics appointment

5/21 - overnighted RFE documentation to Missouri

5/24 - notification that response to RFE received

6/14 - changed address on-line, then called

6/18 - mailed I-865

6/19 - all touched

6/20 - all touched

7/06 - notification AP and EAD approved

7/16 - AP letter and EAD card received

9/23 - AOS Interview letter received for 10/29
