Hi:

New to the forum. Thank you all for your help.

My mother (Permanent US resident) is applying for my brother (divorced) for green card. He lives in China currently. Besides birth certificate proving their relationship, does she also need to provide any other document(s) proving his unmarried status when filing I-130?

A copy of your brother's divorce certificate might be needed to prove that he is unmarried at present.

of course, there is a marriage certificate for your brother, and legal permanent residents cannot file for married children

so he must prove that he is single, unmarried, and that is proven with the copy of the divorce decree and translation into English of said document

I was divorced when my USC mom filed for me so we had to send a copy of my divorce decree and translation to prove that I was unmarried to be in the F1 category as an unmarried child of a USC


now if the child is single there is no need to prove it

but if there is a marriage certificate, then there needs a divorce decree to be attached
