Thanks. I called. Fees are nonrefundable. At this point we are willing to lose the visa money if that's the case. We just concerned whether this will be a reason for denial for my fiancé because the baby mom is being so negative after she agreed. She had a change of heart I guess. All I wanted was give the child a better life even though being away from the mother is hard but who knows.

The fees are nonrefundable, but you can pay the fee in advance, just save the receipt that you received for when it is time to schedule his interview.

For USEM, put together your financial packet as outlined in the Embassy Letter: EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form may be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You may also be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

Once you are at the interview, chances are very strong it will not be asked for. It is recommended that you have the documents completed but you probably will not be asked for it. Most have not been asked for the financial for 8 months now. We think it will not be asked but the EL still "recommends" it. You don't need a co sponsor. Just explain to the CO, and ONLY if ASK, then tell the truth about you taking some time off to finish your testing.

You're going to be fine.

As long as the Tax transcripts show more than the poverty line (approximately 20k per year) then the money in savings is irrelevant.

Money in the bank or lack there of, does not have a baring on the outcome of your interview. What does is if your family size meets or exceeds the 2016 poverty levels. If they do you should not have a problem.

Your fiancé can complete her interview an attain her own visa. For the daughter she has one year to process as a K-2 to follow or her 129F will expire. Visa procedures for the daughter is the same as mom with a couple of changes. When your are ready pay the visa fee (if you already have then it's good till your application expires) schedule the appointment and finish the medical. If you have an appointment for the child and decide she is staying behind, then just cancel the appointment which is all you have to do. Fees are non-refundable.

You need tough lover here.

Now your fiancé has to take a stand. If she is the biological mother there is nothing legally that your fiancé's mother can do to withhold the child. Your fiancé has to grow a set of "brass balls" and put her foot down. Now there is going to be trouble and you are going to be seen as the "bad guy" but love has to prevail here or your fiancé's mother is going to be trouble for the rest of your life. Of course, threating to withhold any money you maybe sending the family in the future could change her mind.

I am not close to the situation but that is only my opinion.

Got my NOA2 hardcopy today. 4 days not bad. Now I'll wait until the end of next week to start calling to see if I can get the case number.

After its at the NVC, does it then get sent to the beneficiaries home country or is it just held there until all of the other stuff is done (DS160 etc etc)?

I think you are missing the point. It's the dad of the child who is her Fiancé and it's the mother of the child who doesn't want the child to go anyway.

This is getting confusing. So the bio father is divorced from the bio mother and he is remarrying and immigrating to the US with his new fiancé.... do I have that correct"

If that's the case then I believe the child should be with the mother and the door left open if the mother later on wants to let her immigrate to the US as a K2.

my rfe came today they say that they need a evidence that she will marry within the 90 days of entering the US they said they either need a statement letter of intent to marry or wedding preparations or other evidence that cleary establishes her intent to marry well i thought for sure that all the pictures from a huge engagemnet party showing all of us and the family and the banners that was made up saying engagement party for her and I with our names plainly stated i thought that would work and if she has to write a letter can she write it and email it or does it have to have wet signed and the other thing they stated they needed was i guess all the pictures that we sent they must have not looked at them at all because they are asking for pictures of us again they were infact inside of the packet and now i am wodering where the hell they went anyways does they letter have to have wet signed thanks

A letter from you and a letter from her is required as one of the required documents. Don't assume anything. Do what they require and you may get through this. A letter from you and a letter from her is required as one of the required documents. Don't assume anything. Do what they require and you may get through this. A dry signature is fine but it needs to be returned with any other document request. Follow the directions as they are clearly stated in the 221g.

Sometimes things don't make sense to us and we start to take shirtcuts. Shortcuts when doing your visa is not a good thing.

so just making sure it would be fine to have her write out a letter and sign it and then email it to me and then print it out and they will except that i do read what you said but just making sure 100% that i get exactly what you are saying
