We received RFE today it reads as follows:

You indicated that you met the beneficiary through the services of an International Marriage Broker (IMB). You stated that you met the beneficiary through www.elenasmodels.com. This website is considered to be an International Marriage Broker as it is a business that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between United States citizens and foreign nationals. Therefore, you are required submit a copy of the signed written consent form that the International Marriage Broker obtained from the beneficiary, Nadezda....., authorizing the release of her personal contact information to you.

I anticipated this being an issue prior to filing the I-129F, so I sent in the following with the I-129f petition. Apparently this wasn't enough.

What can I do to satisfy this RFE? No consent form was never signed by her, nor did the website ever give me any of her personal information. We exchanged a couple of messages through the site and then shared our personal contact information with one another.

I have obtained a letter from Elena's Models where they claim that they are not an IMB. (Please see attached.)

Any help would be greatly appreciated!!!

Here is what I sent with the I-129F:

I-129F Response to Question 35.a IMBA

Elena's Models

Suite 328

15 Albert Ave

Broadbeach, QLD 4218

Australia

Phone : +61 (7) 5641-0334

www.elenasmodels.com

Nadezda and I met on the website Elena’s Models in April of 2014. It is to my understanding that USCIS views Elena’s Models as an International Marriage Broker. When Nadezda and I met I first saw her profile on the website and sent her a message showing that I was interested in her. She replied to my expression of interest saying that she was also interested in me. We exchanged a few messages through the website when I asked if she would like to talk through text iMessages. She then gave me her phone number and we exchanged several messages. After talking for a while we decided to talk using Skype. We had several Skype video chat conversations. Our actual communication with each other on the website was very minimal and limited to about 3 or 4 messages before we started communicating off of the site.

At no time while on the website did Elena’s Models provide me with any of Nadezda’s personal contact information. The personal contact information that I did receive was directly from Nadezda herself. Based on this I don’t think that Elena’s Models served our situation as an International Marriage Broker.

Please let me know if you have any further questions regarding this.

Thank you,

Your letter along with Elena's Model's letter should satisfy USCIS. Follow the REF letter for the returning of your response.

Good luck. I think you will be ok from what I have seen from others. Basically they did the same thing and it was accepted and their application was approved.

Hi guys, noticed a few people who were concerned about the delay on NOA 2, for those who received NOA 1 around December 21.

We were also starting to panic, given that we hadn't heard anything and we had the same timeframe, but we received our physical NOA 2 through the regular mail today. However, our online records still aren't reflecting this, hence why we were starting to worry something had gone wrong.

I guess what I'm saying is check your post, and that the online may not be indicative of the actual status at the moment as they don't seem to be updating them frequently for some files. Hope this helps to calm a few nerves :)

It usually takes 10 business days (without holidays) to receive your NOA2.

Have you check CEAC for the most current update https://ceac.state.gov/IV/Login.aspx

As a K1, when checking your case online at CEAC you have to select "immigrant visa" as it is treated as such, even though it is a "non-immigrant visa". Don't ask why, as no one has been able to articulate why!

Yessssss guys, keep the faith rolling! both my app and the USCIS say that my case was received, but just like the other 2 above me, I check my mail and bam there's my NOA2 hard copy, with an approval date of 2-4-15. I almost started crying because I was sure it was an RFE. I feel like finally the cases are rolling in! Good luck everybody, the approvals ARE coming ! :)

You have been so patient and positive through this whole process. I salute your tenacity. Stay strong and I wish you nothing but the best of luck during the upcoming processing for the visa. Believe it or not, passing USCIS is the hardest part of the journey and now you are on the other side. It'll be a breeze for your interview. Less than 5 min and your out of there with an approval.

No I get that, I was just saying that we had the hard copy of our NOA 2 through before the online record has been updated, and given that a few people have also not seen any updates through the website or the app I thought it was useful to mention :)

Thank you, I feel like you and a few others have helped me out so much! Without your knowledge, I would still be super lost. I'm super anxious for the next step, but there's no other option than to take the bull by the horns and go for it!

If you sent the 129F with the correct address 99.9% sure it is correct. They have people who transpose address' to send mail and sometimes they can make a mistake. Just keep checking your documents and if you see a pattern that everything is address wrong then you will need to go in and make an address change. For now, it's not a big deal.

Can you please finish your profile so others can see what visa you are chasing and what country you will be processing through. This sometimes is needed information to help you with your question. Simple steps to change your profile; Select your picture>Edit Your Profile located under your picture and scroll to the bottom of that page to "immigration profile" and you will see "Immigration Status". Use the drop down box to choose your visa type. Then save and that's now complete.

Thanks

Thanks for your response.

My address in the US is correct, just her address the street name is wrong with 1 letter: In application (Tu Ninh instead of Tu Minh)

What i really want to ask was, a slight mistake like that will throw them back while doing background check ? and Probably delay our case? Is so should i do it now, or later ?

See below

The length of processing is determine by a number of factors; your country, your personal background, family etc. No two people are the same so the length of time varies. Normal processing is 30 to 45 days but I have see it go upwards and beyond 6 months.

2 1/2 years ago when my wife processed it took us just over 90 days. Be lucky it's not running on the timetable. This is a game of patience. Those who have the most will be much more relaxed. There is anyone here that doesn't want to be with there lover, so in that respect we are all the same.

Thank you for your encouragements

No, it will have no baring on your case. You should be fine as long as your 129F is showing the correct address.
