Ok, so we had the interview this morning. We had an absolute ####### of an interviewer, who harrassed us about the affidavit of support because Ed didn't file taxes last year (he didn't have an income high enough to require it, he was in England for most of 2005, duh). We sent in employer letters, paystubs and contracts from Ed's school (he was on a fellowship last year) but he still didn't believe that he earns enough to support me and told us to submit this years tax returns. We gave up arguing and just said 'ok, fine, we'll send them in'

Theeeennnnnn, he says, but this isn't the reason you aren't approved today, your namecheck still hasn't cleared. Apprently he expected it in today, but it wasn't there, so he is going to request it today. I thought, ok, so this means that it is almost done then, just a couple of weeks or something. But no, then he said, it will probably be cleared within 2-3 months. GRRRRRRRR!

i was hoping to go home to for my graduation ceremony in May, but it looks unlikely now. And I'm guessing that isn't a good enough reason to infopass for advance parole either :)

Oh well, it isn't the end of the world, just midly frustrating. I'm mostly annoyed that he was such an a**hole about the whole thing. If he had said it nicely I wouldn't have minded sending in tax returns at all! It just seemed like he hadn't read our file at all. Grr.

Anyway, I've taken the rest of the day off work so I'm going to sit outside in the sun, how lovely.

ugh, I'm sorry to hear about the crappy interviewer...Some USCIS employees really aren't the nicest, but hopefully they'll get it cleared up soon :wacko:

haha, yeah I'm trying to keep positive about the whole thing! I was joking last night to hubby that it might be my last night before I get deported, but he didn't seem to find that very funny :) Well, we're off to H&R block to file taxes now, we've been so lazy not doing it until now...

When in May is the graduation? My husband's AP took about 9 weeks to arrive. Of course that was in late 2005.....

And not to pick on you nina.....but let this thread be a lesson to those reading about NOT filing for interim benefits banking that you will get a speedy greencard. There can be any number of bumps in this road, unfortunately.

Sorry to hear about your situation. And the fact that the guy was a jerk!

Why is USCIS so inconsistent? Some people get interviews even when the FBI namecheck is pending and others don't get the interviews at all?

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

Definitely a lesson well learned, unfortunately money issues at the time meant I didn't apply for AP when I applied for AOS, and once my greencard interview was scheduled I just decided to take the risk. The graduation ceremony isn't that important to me, and now I'm going to go home over the summer instead, and hubby can come with me :) He has his graduation ceremony here at the same time as mine, so at least I can see his now! I'm still reluctant to apply for AP, mainly because I hate putting more and more money into UCSIS! But I will, it's just not worth not being able to see my family and friends.

Good luck to all in the same position!

Oh, and thank goodness I applied for an EAD - I would recommend NEVER leaving that one out. Mostly for sanity purposes.

I've seen more than one thread in this forum and the EAD/AP forum where people actually ADVOCATE not filing for interim benefits. From my point of view, it's a very misguided perspective. I mean, it's great to see that it's not taking as long to obtain a greencard as it did when I first started a visajourney with my husband, BUT.....

The fact of the matter is this - the US government is under absolutely NO legal obligation to get a greencard to a petitioner in a required window of time. There is no legal mandate in CFR for turnaround times and there will likely NOT be anytime soon. National security is viewed as uppermost and greencards WILL NOT be issued until a petitioner has passed namecheck.

As I've said before though, in a few months when the fee increases go into effect, this will all be moot. The I485 petition will come with automatic EAD's and AP's. Most likely because the namecheck backlog is growing, and more people are going to find themselves "stuck" for long periods of time.
