Finacee Applying for New Job Out of Country

Timeline

My poor girl is tired and stressed (mainly because of her life in Singapore for several years). Been over a month now since NOA1 and nothing else yet. So she finally be going back to Philippines next weekend to stay with family for a few months until America. However, she keeps thinking we are going to get denied. She is stressed and says if we not getting NOA2 approval after Christmas, she is going to apply for another job in some other country. Now with that i got two concerns. mainly, her safety!!! She could find herself in dangerous waters and not know it. Two, this could mess up the visa.

So that is my question there... will her working in another country affect the K1 application? If not, then all I need to worry about is her safety.

The NOA2 tends to take a while. For us it took about 40 days or so. The good new is that if you already have the NOA1 you can check the status of your package with USCIS by putting your receipt number here:

https://egov.uscis.gov/casestatus/landing.do

There are other filipinas there (some in singapore) going for the K1 visa. Most are getting their Visa Approved!

The issue with her going out of country is the the US Embassy asks about that during the interview. I am not sure if that is a bad thing, but I do know that she will need a police clearance from anywhere she has been for 6 months. Another issue is that if she goes to another country, how will she do the interview? Assuming the interview is supposed to be and the Manila Embassy (depending on what address you put on the i129f.. once approved it will end up at the US Embassy closest to the address you put on the i129f). If she goes to work in thailand and the k1 visa case is already in US Embassy in Manila, I am not sure what happens after that.

As for her safety, DO NOT allow her to go ANYWHERE in the middle east. It is NOT as safe as you would like for your filipina.

I would question her commitment to the process and more likely to your relationship. If she is willing to give up now and pack her bags and go elsewhere then you will find a very difficult and tiresome process. Believe me, you and her do not want to go down that road she is about to choose. Right now she is so close to getting the NOA2 and she is going to make yours and her life difficult because she can't wait another week or two.

We processed our K-1 about 2.5 years ago and it was taking more than 90 days to receive a NOA2. I'm just saying!

If she is looking for another job in another country, she is most likely the breadwinner of her family. You need to nip this in the bud right now. You need to make it plain as day to her that she will not be sending her entire paycheck home to her family once you are married. It's very common for Filipino children to send money home to their families.

You need to set her budget clear and concise. I told my wife I would need 2/3 her pay to pay the bills and mortgage. She is free to do whatever she wants with the other 1/3rd. As my wife loves to shop, she is soon discovering that with our own expenses, that both saving for the future and sending her family money are pretty much impossible.

Would she have to sign a contract for this overseas job? Would there be a penalty for ending the contract early?

I have seen posts on here where Filipinas have signed a new contract and needed to get out of it and they have to pay a financial penalty to their employers.

I agree with all the posts before me. Slightly concerning that she is not having patience during this process. Are you supporting her financially during this time. Also, very important to get on the same page regarding sending of money once before she arrives to the US.

she needs to be patient. the whole process may take awhile. You need to check how faithful she is to you. But maybe she is a breadwinner of the family that she can't afford to be out of work. When she gets to the US it will take a while too before she gets a job. U 2 need to get married, file AOS along with employment permit.. Goodluck, i hope everything will go well with both of u.

It takes 5-8 months lately for the petition to be approved, you only got your NOA1 a month ago....... more patience Scotty.

Working in a foreign country will not get a denial. On the I-129F did you list her address as the address in the Philippines, and not the address in Singapore?

Your fiance will need a police clearance for any foreign country she lived in for 6 months or more after the age of 16. If she does not have a police clearance from Singapore, she will need that.

Your fiance will need a police clearance for any foreign country she lived in for 6 months or more after the age of 16. If she does not have a police clearance from Singapore, she will need that.

^^^^ Ours took about 9 months from NOA1 to visa in hand. We started in October 2012 and Joan was in Hawaii by June of 2013. It is a LONG process wrought with fear and insecurity "(they are taking so long because we are going to be denied!") No, they are taking so long because that is how long the process takes. OP: Your best option is to relax and buckle up. You have a long ride ahead of you. Constantly reassure your fiancee that this is a normal waiting period and that she does not need to worry. Let me answer some of these, and I do thank you all for answering.

kris&me, I hear ya. Me, I see just about everyone with evil intentions. I dealt enough with them.

Yuri S, yes I check the status daily. Not updated since 10/28. I called the number but I can not pass the auto attendant. Zero is disabled, no humans seem to be available. I know this will take time but after all the stress and poor work conditions she has been through, she does not want to be moving to her homeland only to just sit at a relative's and not work for a few months (because I am told they do not hire people her age). She just anxious for life to restart and not be stuck from horrible work conditions to sitting and being broke.

Greenbaum, I understand what you saying. Sometimes she makes me feel guilty if I lose my temp job. Then what?

Mike-eeh and Odie, no, she does not give her family money. She does not support siblings, cousins, etc. She survives on weekly funds just as I do.

Tahoma, the petition mainly because of me owing money and having a temp job.

JL818, no. One, she would not want me to give her money because it is hard and tight for me as it is. Two... go back to one.

Based on the response that you provided above, my thoughts are that she should probably just stay put instead of looking for another job at this time, especially in another country. It is likely just going to complicate things at this point for her to go abroad again. Can you clarify what you mean that they do not hire people her age in the Philippines? I'm sure she can get something to hold her over in the mean time, and it seems to me that it would be much more expensive to travel abroad for the short term. My fiancee had also done some short term employment abroad (e.g., Singapore) and what ended up happening was that you have to work for about 6 months to even begin to keep any of the money you earn anyway since you are required to pay back your agent, or other, fees.

In the meantime, it looks like she might have some concerns about supporting herself. If possible, you might want to consider providing her with some financial support her during the time that the visa is processing. Although, you say that you are short on funds, it should only be for a relatively short time. Being that you wish to marry her you may end up having to support her for some time while she is in the US anyway, as she might not be able to find immediately employment, and it is probably more expensive supporting her in the US than in the Philippines anyway. May as well get used to the idea that you may end up supporting her at least a little if you are in this for the long haul.

From your timeline, it looks like you have received your NOA1 over a month ago from CSC. My experience is that CSC has been pretty fast (from NOA1 to NOA2, it was only a month for us and we got ours recently). If calling them isn't working, I would try emailing as I have found that they usually respond within 2-3 business days.

I do call but I only get an automated device that blocks 0, and no way I found after spending countless minutes pressing buttons to speak to a human. Quite similar to calling the DMV or bank or IRS, no personal connection.

What email? I seem t be unable to find it for this specific reason. I would love to try, as long as they not blacklist me (like the IRS and USPS has, then again, that is why I have 30 accounts).
