Adding to this--and I'm sure it's already been asked--how do you file your taxes if your spouse has no SSN? The Form W-7 says submit only if you do not have or are not eligible to receive a SSN.

Does this apply? I'm running out of time!!!

We sent in the W-7 with the tax return, but I forgot to send in a copy of his passport :bonk:

and by the time we got the letter asking for it--it was close to time for his EAD to arrive, so we didn't respond to the request and the W-7 wasa of course denied.

August 2009--Permanent Resident Card arrives!!!!

We are Finished with Immigration for 10 years!!!!

Wow..great topic! I was just about to ask a similar questions. Is there anything else I would have to do to file jointly? My wife has been here since last July so (I think) for tax purposes she's considered a resident (?). This is a dumb question, I know, but will IRS raise an issue if they see no W2 for my wife? She hasn't found a job yet.

Also, mucking around with Turbo Tax, it gives me the 3300 personal exemption/deduction as well as for my wife (she has SSN) for a total of 6600...wasn't sure if this was right.

Your wife doesn't have to be employed to be on a joint tax return, so no W-2 for her is necessary. Yes, the deduction doubles if you're married, so if you're a one income family (like mine) you pay significantly less taxes.

Feb 21/2007 - AOS transferred to CSC

Feb 22/2007 - Biometric taken ( for AOS & EAD )

Mar 09/2007 - AOS approved!!! at 10.30pm :)

Mar 15/2007 - Received Welcome Letter in the mail

Mar 16/2007 - Received Permanent Resident Card !

Mar 20/2007 - Change name & status on SSN Card

Apr 07/2007 - Got learner's permit

Dec 08/2008 - File for Removing of Conditions

Dec 08/2009 - File for Naturalization

I am trying to figure out the same thing. It states in Publication 519 that you can treat your nonresident spouse as a resident but you have to claim worldwide income. I am really trying to not going to a tax accountant but I am not sure I am going to be able to work around it. Darcy will be filing taxes in Canada too so why should we have to be double taxed? :blink:

He should have a P60 showing amount paid to him and amout of tax paid for the tax year 2005/2006, he can also work out how much from his paychecks from Jan 2006 to april 5th 2006 and from april 6th until he left his job he should have a P45 add the total wages together and that will be his Gross earnings, add the tax paid together and that will be the total tax paid...
