Hi All,

I currently have a pending I-485 through my husband's pending employment based green card application (his I-140 was approved).

Our I-485 application has been pending since aPRIL 15, 2015 and today I received the following notice:

"On November 25, 2015, the Post Office returned a notice we sent you for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number LIN1513550306, because they could not deliver it. This could have a serious effect on your case."

We recently moved and although we had the lawyer update the address I understand it might be the reason for the inability to deliver the mail. What I am worried about is that prior to this change my status was pending and there were no updates on the case. I though that usually if the case is approved or if there is an RFE the online status would change too. Also, my husband status is still pending with no changes since April 2015. Anyone went through a similar experience before? can this be a denial notice that they are trying to send or would that be updated online as well? We already had our biometrics appointment so I am not sure what else can this be.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The notice could be anything and not necessarily a denial one. Sometimes USCIS online status does not show the actual status on time. At this point, you should contact USCIS Asap and get the notice delivered to your new address and act accordingly.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

i wonder whether perhaps your lawyer only filled out the regular change of address form, and didn't separately update the address on your pending petitions?

I would suggest calling the number listed in Step Two of the USCIS-recommended procedure for address changes during an immigration process and talking to a human to make sure that the address change is reflected on all the outstanding parts of your applications.

  • Step 2: Change your address on any pending or recently approved applications or petitions, online OR by phone at 1-800-375-5283. For TTY (deaf or hard of hearing) call: 1-800-767-1833.

Without knowing where you are in the AOS process we can't even take an informed guess at what the missing notice might be. It will be easier for people to help you if you :time:

Eighteen years in the US and I still don't understand Velveeta, TV ads for prescription drugs, only getting 2 weeks paid vacation, or why anyone believes anything they see on Fox "News".
