Sounds like we have a plan!

Reading this forum has brought a lot of good to me and my fiance :) At least my mind is more at ease since last night and Im pretty sure that means his is as well :P

We will most likely get married in a courthouse next time I go there, in 2 weeks and have a legal marriage. From there we can file the I-130 and then the I-129F. Meanwhile, we can plan for a religious ceremony, wedding with vows and all that, back in Montreal. I guess it could be seen as a "re-affirmation" of vows. Meanwhile, the paperwork can get done and we can start planning on finding an appartment in the States and etc.

Ive been reading that it's difficult to visit your husband if you are in the process of waiting for a K-3. I've been reading about visitor's visas. I've been to Colorado about 3-4 times now and I've never needed a visitor's visa to go. Am I supposed to get one because I'd be his wife now ? And if I always bring a letter from my employer saying that Im only on vacation to visit for a week and will be back at work the following Monday, will that be acceptable to the US Customs ? Or there's a good chance that they send me back home ? One would think that its normal to visit your husband when you are planning to go live with him(and who doesn't want that when they are married o_O). One would think it's normal that I go there a few times to go appartment hunting for one, finding doctors and etc. So what's the suggestions for travelling to visit your husband even if it's never for more than a week, will they really give me trouble ?

Thanks for all the insight, it's truly amazing to be able to share this with so many people that are going through the same thing, and I hope to be able to give someone advice as my fiance and I travel down the Visa Journey ;)

Timeline

I visit quite frequently and bring as much ties as I can back to Canada (letter from employer, apartment lease, current utility bills, tax stuff from Revenue Canada) as well as any and all immigration paperwork to show that I'm not trying to skirt the system and that we're filing things the legal way). I also travel very light and always fly so I also have proof of a return ticket in the form of an itinerary.

Be honest, but I would not tell them I was going apartment hunting or anything like that. Make sure you don't have anything on you that looks like you're going to stay or are skirting the system (e.g., a resume, apartment ads, doctor's lists, etc.).

It's never 100% because it is down to the individual officer you encounter. Some people get pulled into secondary but some don't and some people do get denied entry. Be confident, smile and remember, BE HONEST! The good thing about being Canadian is that you go through preclearance in Canada.

anyone else have any visiting advise? we are worried about her getting "banned" or blacklisted. my friend at the immigration office is telling us this could be an issue.

Timeline

The more proof of ties to your home country you take with you, the better. Pay stubs are a good piece of evidence, especially the most recent one, plus a letter on company letterhead from the employer giving the expected date of return to work.

There is never a guarantee that you will be admitted into the U.S. even with proof of ties, but the more proof you have, the better your chances.

I travelled to the U.S. frequently while our K-1 process was in progress, and most times, I simply stated that I was visiting my fiance, and they would ask my date of return to Canada, and I was on my way. A few times, I was asked for proof of ties to Canada and I was even asked if we had heard of the K-1 Visa, to which I replied yes, and it was currently being processed. I was never refused entry to the U.S., but I travelled by car, not plane.
