I'm filling up the I-765 form, I'm confused what to answer with the question " Who may file I-765", I'm on K1 Visa and we got married within 90 days, but now my visa expired already. What do I need to do? Thanks

You need to file the I-765 with your Adjustment of Status. You are no longer eligible to file based on your K-1 status, since your I-94 is expired.

When filing with your AOS, you are category C 9 -- Adjustment Applicant.

Refer to page 5, number 7.A of the I-765 instructions: http://www.uscis.gov/sites/default/files/files/form/i-765instr.pdf

While trying to answer question I'm also searching for some sample wherein it made me more confused.. Since I'm married and I'll be using my spouse name I should write my spouse family name for the question 1. FULL NAME ? and my middle name would be my family name before marriage ? How bout the OTHER NAME USE (INCLUDING MAIDEN).

Thanks for helping.
