My husband just told me our marriage is over. he waited until after I filed the paper work. I found evidence that he has been having a affair . he has not has his biometrics appointment yet what should or can I do.

That must be heartbreaking but you can divorce him and move on with your life. He really doesn't need your help to ROC. He can always file a divorce waiver if you guys are unable to patch things up unless you have actual evidence that he did not enter the marriage in good faith.

Op does he have a green card at all yet? If not, he cannot get it at this point without you

But he knew I couldn't have kids, before we married . Now he saying he want kids it been his dream all along. And I cant give him legacy. He just said everything I wanted to hear now he has changed everything. I reminded him of the promises he made and like what promise life and people change. I feel used. Pull your affidavit of support immediately. He cannot adjust without you. Yes, some have interviews waived but if you do this he cannot adjust.

We are doing removal of conditions. his green card expired November 21. we received the letter extending it for one year while our application is in progress. We have not received his letter for biometrics yet. How can I pull my affidavit of support.

Ok your story confused me. At this point then you cannot pull your affidavit of support. Providing he has proof that the marriage was bonifide you're out of luck

I found documents that he has been having an affair. even last month he went to clinic to have test for std. Also I read if he never makes his bio appointment our petition cam be considered abandoned

Right, but he only needs to prove that he entered into the marriage with good intentions and that you were living as man and wife. Yes he does need to go to his appointment but can ROC without you

Sorry for your situation, OP.

At this point his journey to remove conditions can be stopped by direct evidence that he married you SOLELY for immigration benefits. Even if the marriage ends in divorce, he can still likely get a waiver by claiming he entered the marriage with good intentions.

If you have definitive evidence of fraud, you should present it to USCIS. But if all you actually have is evidence that he is/was a terrible husband (which seems to be the case based on what you've said so far), it won't change anything.

Realistically, the only decision for you to make at this time is whether you want to take initiative to file for divorce or not. At this point I would recommend talking to a divorce lawyer so you can plan the steps to protect yourself financially and ensure he doesn't do any more harm to your life.
