Hello,

I am the petitioner applying for my spouse and 2 children's IR-1/2 visas. My spouse and one of our children received appointment letters for their interviews at the same time. I thought that children under 14 didn't need interviews if deriving from an IR-1 applicant. We have two children (3 year old twins, not USCs) and it seems odd that only one of them has been given an inteview letter. Also, we planned for my partner to attend the interview on her own (save the expense of all of us travelling to London). I will of course e-mail the embassy for clarification, but can someone just let me know if my 3 year old has been given the interview in error?

Thank you!

Hi, I have applied together with my CR2 daughter as well. We got approved a few weeks ago.

Formally all applicants need to attend the interview, regardless of their age. It's odd that your other kid didn't get an interview letter. I think the NVC might not have realized that they belong to the same family - all your family applicants need to have the same appointment date and time.

You must call the NVC urgently and discuss with them - there is a risk is that your wife and kid will get their visas but your other child might not.

In practice what happens is that the embassy just wants to have the kids there. My daughter is 8 and the CO didn't direct a single question at her.

This is directly from the US EMbasy London Website, which is why I am confused? I guess that a CR-2 is not considered the same visa as the parent (CR-1)?

I have used the embassy contact form to ask why our 2nd child hasn't received the same appointment as the 1st.

'Children under the age of 14 who are deriving status from a petition filed on behalf of a parent and are applying for visas at the same as the parent, are not required to attend the interview. You may bring their documents with you. They require a passport, if they are not included on your passport, two photographs and a birth certificate.

Children aged 14 and over, and children (regardless of their age) who are the beneficiary of their own petition, must attend the interview. Children regardless of age require a medical examination.'

The thing is, the child technically is not getting a derivative visa (unlike, say, the child of a sibling petition), you could have applied for a CR-2 by itself.

How long ago did you get the interview letters? if it was recently, I would guess the third letter is a few days behind, got stuck in the post somewhere. There is also a small chance they didn't realise there is two kids, since they are twins with the same birthdate.

Does anyone know approximately how long it will take to receive a reply from using the embassy's contact form on their site?

I sent my query yesterday explaining that I was the petitioner and that my spouse and one of our children had received interview letters (in the same envelope, for the same appointment time), but that our other child didn't receive an appointment letter. I undestand now that they all have to attend an interview, but I don't want to book train tickets & hotel untl I know for certain that they are expecting all 3 applicants (i.e. don't want to bring my little boy back weeks later). I provided names and LND numbers in my query.

I read in another thread that someone waited 19 day for a response! The interviews are just under 4 weeks away...

I think they respond sooner to actual problems than things like "please tell me my interview date" but it can be anywhere from same day to a week. There are so many different response times people have reported.

If you show up with a 3 yr. old, they aren't going make him wait outside, especially if another adult with you isn't standing there looking available to babysit. Once inside, I am sure they will process all three whether the one got a time slot or not. Let that be your Plan B if they should overlook your email request.

:) LOL I didn't think they'd make him wait outside! I just worry that they won't process him on the day and will make us come back. I suppose I will just book everything now and keep chasing if needed.

Once inside, they would be insane and cruel to not process him with the other two family members. It's not like he will take up any extra interviewer time having to answer a bunch of questions. Just another set of papers to push through. I don't think they would refuse to do that. They are pretty nice as well as flexible.
