Hi, My fiance do not have tax return because of his tax issue. Just want to ask if there is anyone here had experience getting denied because of tax issues of their Fiance.

he can ask for a payment plan and show proof that he is paying his takes

has he filed taxes? if not he can file the last 3 years and request a payment plan and start paying what he owes

He's got to be on a payment plan with the IRS and making those payments. If this doesn't cause a problem at the visa interview it could very well be a problem when adjusting status, Though at that point he could secure a joint sponsor but that may not be enough.

They won't look into if he owes taxes or not but he must have filed for the years that they want to see tax returns from.

My husband was behind on filing his taxes but he filed them all when we were getting my visa. At that time he didn't pay or make a payment plan and it was never an issue. (Not saying he shouldn't pay his taxes! He definitely should! My hubby is all paid up now. Just saying it won't be an issue)

Manila is known to be one of the tougher embassies regarding the affidavit of support.

It's dangerous to say that it won't be an issue.

I was never asked by the CO in Manila to present the copy of the taxes that was paid by my hubby in the last 3 years neither the affidavit of support. I was ready and frontloaded my case with lots of supporting documents but they never asked for it. I was only asked to show him of our photos together. That's it so I wouldn't worry too much about it.

However when it comes to AOS, it is very important that your hubby can show proof that he pays the taxes that he owed when you file your AOS as this might affect your case.

Lately it is hit and miss with the embassy asking for support over the last year. Not sure why, the requirement is still listed in the instructions letter, yet many times the CO does not ask with the K-1 visa.
