If you have evidence that you entered into the marriage in good faith (and you alluded to some that you have), just file with a divorce waiver. No lawyer is necessary for the ROC if it is a simple "we got divorced" and now I'm filing to remove conditions. I would disagree that it is better to have a lawyer for this process. Unless you have a complicated case, a lawyer is good money poorly spent.

Also USCIS does not care if your marriage worked out or not. If your marriage was legitimate and you just happened to get a divorce (which seemd to be your case), there should be no fear of a denial. Good luck! :)

You can file on your own, but it's better to get a lawyer, a good one unlike the one you gave you that weird advice. Collect evidence of good faith marriage and file for ROC with divorce waiver. Which state are you in?

A lawyer in this case does nothing unless the person a) has no time to do paperwork and b) is unable to figure out the paperwork.

This is a simple divorce waiver ROC case. They have evidence they co-mingled finances (bank accounts) and lives (joint leases etc..) so the OP should be fine. I've seen waiver ROCs approved with less.

If she signs the I-751 form indicating that you two are married and it is a joint petition, but you are in fact divorced, that is a blatant and willful misrepresentation of the relationship. You would be committing immigration fraud. When you sign the form, you are agreeing that the information therein is true. USCIS does not care if you and your ex are still on good terms.

Tell that lawyer to shove it and never ever listen to them again. Why do you believe when you already know that there is an option for divorced individuals, that somehow you get to lie and bypass that process?

I totally agree about this particularly lawyer. The more i read about people's issues the more i am considering of starting the topic about the lawyers to warn people not to make mistakes and not to loose money. bad lawyers i mean. before my husband and me got married we had the experience with one of so called immigration lawyers.

i think people should know where NOT to go.

Well I asked other lawyers and they all want me to find a good lawyer in my city. But here feel like every one is encouraging me to file it on my own.

I already have my divorce decree, letters of support.

I believe the only issue would be that there is an age difference between my ex-wife and I, but we were approved before with no issues.

Also there was a psychological hardship on my that my therapist does not mind writing a letter to support me with that.

But is there a guide to how to file on your own and how to fill the paperwork?
