Yes, relax, and do not stress this. As far as your status is concerned you really have the upper hand here.

1. You have your green card. They cannot take that away from you. You can leave your wife and remove the conditions on it on your own. Just collect evidence that your marriage was in good faith: wedding photos, bills in both yours had her name, holiday cards sent to your house in both your names, etc.

2. If you are worried about money, their sponsorship of you continues, even if you divorce. They must support you until you become a US citizen or work 40 quarters (about 10 years).

3. They cannot deny you visitation of your son. In fact a court can award you visitation. But like I said, with their history of drug use, if you can prove it, may just award the child to you. At that point, you can solicit child support from them as well. As a father, you have every right to your child. Your status as an immigrant does not matter.

4. They can't have you deported.

5. If you are really being abused, you may be able to file under VAWA and obtain your green card/citizenship that way.

I would think emotional abuse is more difficult to prove (re: the VAWA route). Marriages do break down, for all sorts of reasons. Sounds like with an MBA you could try to get a better job and move out, file for divorce, get divorced. Then file paperwork to get the 10-yr green card.

If your lawyer (or you) can prove to the divorce court (not USCIS) that the wife is a drug user, perhaps you can get sole custody of your son. Talk to your divorce lawyer, or legal aid in your area about that.

@Brad, don't mix up USCIS with divorce/family court in your head...they're 2 separate processes. And try your best to support yourself, make your own life better. Collect your paperwork, keep your chin up and keep going!

Was there no signs of her smoking weed and as you said tattoos before you married and came to the US?

First thing you need to do is save some money and get out of her mother's house (she even charges you for a room?). Financial problems but no financial problems when it comes to buying drugs? What a family.

Once you are established on your own, start the divorce proceedings and at the same time the custody papers for your son. If all they do is smoke drugs, and you can prove it, it would give you a good chance to get full custody. It sounds like your wife wouldn't even care if that happened.

Do you have a GC yet, have you tape or have any record of the abuse...as a parent you hae a right to relationship with

your child, you should contact your local Legal aid clinic for help, get a jin 7 find your own place, they cannot send

you home although she sponsored you. UNLESS you did something illegal that can be proven...try speaking to an

atty about divorce, and stay away from them

Highly unlikely that you would qualify for any benefits that would require a Joint Sponsor to re pay, and it seems uncommon for this to followed up anyway.

Do you have a Lawyer?

She smokes weed and know I have videos of her!! It's her mom alcoholic who ruined my marriage!! So she lied to make restriction order!! I don't have lawyer but I do have proofs and videos!! Your questions were answered in your previous thread. Do you have any additional questions?

Find a job and a place to live. Go to legal aid and obtain an attorney. File for divorce and custody of the child. DO NOT call, text, drive by, talk to, send a letter, call, or have any contact with your wife. This will be the quickest way there is to end up in jail.
