I have been married since over 6mnth and my hubby hasn't filed my AOS as yet...will it be a problem when he eventually files?am really worried that I might be deported are something of the sort.

Eighteen years in the US and I still don't understand Velveeta, TV ads for prescription drugs, only getting 2 weeks paid vacation, or why anyone believes anything they see on Fox "News".

You should file for AoS as soon as you can. From the day your I-94 expires to the day USCIS accept your I-485 for processing you are out of status, deportable, and could be detained by ICE and ordered to appear in immigration court. This is obviously something you do not wish to experience.

However, once you actually do file, the overstay won't prevent your I-485 from being approved.

Here's the guide to adjustment of status from K-1. Perhaps it would nudge your husband along a little if you started gathering all the required documents and filling out some of the forms? At this point, only the I-864 (affidavit of support) is filed by the USC spouse, all the other forms (applications for adjustment, EAD, and AP and accompanying biographical information) are filed by the immigrant spouse.

Yes he has had some excuses...hope he does send it off because when I got here I didn't know I could get my SSN so I don't have anything...am just sitting at home.

Hopefully it's not his intent to keep you powerless and totally dependent. At any rate you're doing the right thing by educating yourself and understanding both your rights and responsibilities. Are you included in his financial life in a way that helps to establish a bonafide marriage? That question is for you, not to respond to me or the forum. Are you a part of his will, bank account, power of attorney, lease/mortgage, bills? Just food for thought. Good luck to you.

It would be beneficial to file ASAP, if you wait to long, you will end up spending more money than the 1070.00 to adjust your status. You will then need legal assistance.

I would doubt that there are many mobile CBP checkpoints in Nebraska. However, since you are technically "out of status" until you file for AOS, It may be wise to avoid any travel to the northern and particularly southern border areas. Take a look at this older thread about mobile CBP checkpoints, especially documents you should carry with you. There are numerous similar-themed threads, use the forum search function, inserting "CBP checkpoints" will yield much more information on this topic.

I would strongly encourage you to get your AOS filed promptly. As others have said, and as you are finding out, you can do nothing. AOS is the first required step to getting assimilated into American life. In response #3, Hypnos is spot-on with his posting.
