Hi VJ members,

A friend of mine came to US about 5 months ago under CR1 visa and now she has 2 years green card. She has problem with her husband such as that he keeps bringing some random girls home to sleep with. She is now living at her husband's sister house.

She wants to ask what happen if she divorces her current husband and get married to new USC person. She is awared that she has to do ROC. Will it cause any trouble for her at all? If it will, then what it is?.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

It's difficult to answer this properly unless you post a pic, then we will determine if she will or will not have a problem marrying someone else

As to her immigration, she can file for and obtain a divorce and file for ROC on her own, after which she is free to move on.

After she is divorced, she is free to live her own life. She needs to focus on working, and living an independent life, out of his sister's home. She (his sister) can put her out of her home at any time.

People are assuming a lot and not reading an entire thread before answering.

She can ROC on her own with a divorce waiver. Tell her to make sure to copy anything that shows she entered into the relationship in good faith and/or co-mingled finances etc...How she wants to live her life otherwise is up to her. Who cares if she has a boyfriend now when her husband has moved his new girlfriend into the house.

Getting married again in the future, should she want to, isn't an issue.

After ROC she can obtain citizenship at 5 years, should she want to.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
