Hello everyone,

End of September my K1 got approved, I picked it up, traveled with it to the US where I got the matching I-94 and now we are married and already sent out the application for work permit and greencard.

But today my husband received a letter from USCIS saying we never used the I-129, the K1 would never have been requested and now the I-129 isn't valid anymore.

Did anyone already have that problem and knows what went wrong? And what is happening to my K1 now (that certainly is attached to my passport)? Do you think it's just gonna be a call explaining them there must be a mistake in their paperwork?

Was the K1 visa validated by the CBP officer at your POE? If so, the K1 visa is no longer valid for use. It sounds like you have your I94 printout from CBP. You have a copy of your NOA2 from your K1 visa approval (necessary for filing your AOS). You are in the country, got married. The K1 visa use has now passed. Time to start on you next phase of your immigration journey, Adjustment of Status.

We already filed for AOS as well. That's why we are so confused to receive this letter

I wouldn't excessively worry about the letter if you have already filed for AOS and submitted the requisite K1-related documents. Thanks for finally filling in the blanks.

I have seen a couple of other people post the same thing recently. It's clearly a USCIS/DoS error. I would hold on to the letter and take it to your AoS interview (if you have one), but wouldn't worry about it more than that.

Me again! I thought I would just update you all so that similar cases won't be too worried if that happens:

We called USCIS today. It was definitely a mistake on their side. In the next weeks we will receive a letter stating that the first letter is to be ignored.
