Hi all,

I have a question - my husband's I-765 Permit to Work application was approved this week, but we are still waiting for an answer in I-485 (Adjust to Permanent Resident). Has anyone experienced this before, and is this "normal?" In my opinion, having the I-485 approved seems to be the logical first step (and the most important one) --- should we be worried?

I-765 and I-131 applications are processed and adjudicated separately to the I-130 and I-485 applications.

That's the intention. The I-765 is a permit to work WHILE waiting for the Green Card. It is supposed to be approved earlier than the AOS. Once the AOS is approved and the Green Card issued, that will be the document that allows the holder to work, and the Permit to Work will no longer be needed.

That is normal because that is exactly the purpose, and how the process and applications go together. You apply for the EAD and AP along with the I-485. The EAD and AP are typically approved more quickly than the green card, and allow for work(EAD) and re-entry when traveling(AP) while waiting for the green card to be approved. It is actually logical for it to be this way, as the EAD/AP are not even needed once you become a permanent resident and have a green card.

Thank you everyone! I think I had a brainfart. You are right, it does make more sense AND is more logical - lol!

Just got confused, at times it is all a little overwhelming doing it on our own and I'm always worried we will mess something up. Still waiting for Greencard approval, but at least my husband has been able to start working. Thanks again for all your helpful responses.
