Concerned about petitioner's mispelled name on divorce papers

This coming monday, my finace has his interview at the embassy. We've made it this far pretty quickly and without issues. I applied for the K1 petition August 9, 2015.

My concern now is that my fiance has had an issue all his life where is last name was mispelled on his birth certifiate. The first letter of his last name was reorded aith a 'B' where it should have been a 'V'. It's one of those things that he has procrastanated on fixing. He has had no issues his whole life and all his legal documents such as passport, driver's licence, etc all match his mispelled birth certificate. All, except his divorce papers from a previous marriage and his marriage certificate. Those are reflecitng a 'V'.

We recevied an email from the embassy notifying us of the interview date and letting us know that there is a discrpancy on the spelling of the last name on the divoce papers. Asking us to bring the marriage certificate to confirm it was an error.

Since the marriage certificate is also incorrect, we are very concerned that will cause the Visa to be denied. We researched it and having the the divorce and marriage paperwork corrected is a process that can take 4 or 5 months! We were planning to be together in Jan for our wedding. :(

Since the birth certificate and passport are showing the same name that I filled out all the K1 application paperwork with, do you think that if my finace explains in detail the situation, they would approve the visa? or will they require the divorce paper change that will take 5 additional months?
