Good question. one that is often asked, likely due to the way the posting deadline is described.

From page 1 of the Form I-751 instructions:

  1. Filing jointly. If you are filing this petition jointly with your spouse, you must file it during the 90 day period immediately before your conditional residence expires.

REF: http://www.uscis.gov.../i-751instr.pdf

There are more form filing specifics mentioned in the form instructions that may be of use to you. Many folks follow the VJ guide suggestion to file fairly early in the 90-day petition acceptance window.

When you get a chance, :time: it helps everyone that uses the forum.

Good luck on your immigration journey.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

I came to US on 10/02/2014(Resident since 10/02/2014) and my conditonal resident status(Green Card) expires on 10/02/2016 my question is when do i file I 751?

Within the 90 days before your green card expires. 90 days is not 3 months. Do not file even a day early. Early submissions will be rejected.

Your 90-day window is open before your residency expires. For the earliest filing date you can plug in your data here http://www.uscis.gov/sites/default/files/dateCalculator.html

So I put my GC expiry date and substracted 90 days and I got July,4,2016 So that means I can send the application anytime I want in July 2016?Also Are holidays included or excluded in in those 90 days?
