married less than two years but keep getting IR-1 visa (split topic)

Hi everyboy. I would like to know what happende with you. Here's my experience: got IR-1 instead of CR-1 (to the date we're under 2 years married) Called embassy in my country and they say no mistake...

I entered the US and same, IR. Called de 1-800 USCIS number. Representative connected me with an agent, who told me he wasn't sure, so he would send the request to the "main office" and they should contact me by mail in a few weeks. A month later, no contact, called the 1-800 number again. Representative told me is better to go to a fild office. Set appointment and went. Agent told me it was because we did the process in Costa Rica (my home country) and that's how it works. I said several times that we are less than 2 years married and she responded it doesn't matter. All ok.

Next day I get a call from the Agent telling me she now things there's some mistake, confirmed my Alian number and said she would call again with further instructions. That was over a month ago and no word from her. At this point I don't know what else to do.

Hi in my case... I went back to the embassy and they changed my visa. They said it was there mistake. And they changed it before I fly to the US. Well I got my visa a month ago and it's still say IR-1...they keep making that mistake. ??? I called them and said wait for their reply cus they will investigate on my case. No reply so I called again. Agent said there's nothing wrong. I called the next day and they told me to mail back my GC.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Not sure why you keep waiting on USCIS. Do the I-90 (no fee option, their mistake), enclose the copy of your marriage certificate, arrival stamp in your passport (copy) and the wrong green card (make a color copy of both sides for yourself). Write a cover letter explaining timeline - marriage x date, interview x date, POE x date (how many days/yrs BEFORE 2 yr wedding anniversary), request appropriate green card - 2 yr one. Send it in and wait for the correct green card.

If you really want true follow up, your congressperson's or senator's immigration aide has direct line with USCIS phone and email and can sort this out for you.

You've already entered the USA. Fix this yourself by filing the i-90. You can go for an infopass at the local USCIS office as well. Also only speak to the supervisors or tier 2 representatives (ISO) on the phone.

That's the thing. I already went for an infopass and agent said it was no mistake. Then she called me to say there's maybe a mistake, she would call me back with more information, never did. The field office is not close and I can't be going all the time.

Obviously she was wrong and you need to call to keep on top of it. You cannot have the wrong green card. You will need to remove conditions.

Thank you NLR for your advise. I called again and asked for a tier 2 officer. Finally somebody who knowa what she's doing. First time I called in september they open an inquiry and it's in review. She says I have to send it back, but I should wait for they to notify me the particular adress for my case. I finally got the ID# for that so I can track it. Thanks everybody

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
