The main thread over there is so busy, I like chilling with you guys way better.

Also I received my email this morning for my wifes interview.

Has anyone here filed taxes single even though they are married? My accountant said it didn't matter, but im worried that that could be a reason for denial. What are your thoughts/experiences

You can never be denied because your filing status. Worst they will do is put you in AP until you correct it. No Married people should be filing as single but they do and CO's know. Even idiot IRS and tax accounts tell you to file single. What in the world why? Why? because they are stupid.

Many I know have filed MFS for years it's no big deal. And Amen when they get here and get SSN.

If asked at interview why you filed single you know why and merely say you planned to amend soon as you get SSN. No big deal. I so wish they would make this less heartwrenching

But people need to know if you are married you have 3 choices of filing and single is not one. YOU ARE MARRIED..

  1. MFS= no SSN or ITIN needed (can't e-file. Mail in)
  2. MFJ=ITIN or SSN needed
  3. HOH=if you have qualifying dependents (No spouse don't count)

I mean why not just file an extension? Then yo amen when she get here. Ya'll making this just too hard.

I agree dwheels I'm not changing anything cause I don't want anything to set me back. That is the norm to file what I want my husband isn't here n don't have a ssn. Once he is here then I will worry about what I file.

My wife filled it out for the joint sponsor. It's actually my father in law who is the joint sponsor. She wrote 2 instead of 3. The checklist said "The household size must equal the sum of: Sponsor + traveling applicant + household members. Other than that they didn't ask for 2015 tax forms.

July 20th 2015 - filled I-130 routed to California Service Center

July 28th 2015 - received NOA1 (hard copy)

Sep 22nd 2015 - received email of RFE

Nov 05th 2015 - received NOA2 approval

Nov 16th 2015 - received at NVC

Dec 08th 2015 - received case # and IIN #

Dec 09th 2015 - paid AOS bill

Jan 04th 2016 - sent AOS & IV documents

Jan 06th 2016 - paid IV bill

Jan 08th 2016 - completed DS-260

Jan 06th 2016 - received scan date

Feb 17th 2016 - received 2nd scan date

Mar 18th 2016 - case complete

Mar 28th 2016 - Interview Date Scheduled "May 10th"

Heya, my five cents worth: I was asked in my checklist on the day I got my cc to bring my joint sponsors 2014 W2 form and on his I-864 to correct part 5, item 8. My wife filled it out for the joint sponsor. It's actually my father in law who is the joint sponsor. She wrote 2 instead of 3. The checklist said "The household size must equal the sum of: Sponsor + traveling applicant + household members. Other than that they didn't ask for 2015 tax forms.

Obviously my father in law is married, but my wife doesn't life with them and neither would I be. I've managed to book my medical examination for April 5th. They say it takes two appointments. One the first day, it's paper works and injections, then the next day is X-rays.

Nov 05th 2015 - received NOA2 approval

Im just worried they are gonna look for any reason to deny her. And filing singly would look like im avoiding the marriage, you know?

I would have filed the extension except I already filed my taxes so now I would have to do an amendment to show that I meant to file married.

The run down is, im trying to show every proof of a bonafide marriage

ill probably amend now for the interview correction where it says MFS.

And then amend next year when I do my taxes and she has a SSN. does that simplify it?

Foreign, the way I see it, to me it makes sense to fill single. Your wife doesn't pay US tax while living aboard. Only once she has an SSN can she fill jointly with you.

So they are asking for the tax info for 2015 to be brought to the interview. Im just worried they will question her on the marriage if they look at that specifically. Am I being paranoid?

They asked my husband for 2014 W2's and 2014 Tax Transcripts, but if he had my 2015 Taxes they would take that as well. I did so, they got my 2014, 2015 tax transcripts, 2014 W2's and a copy of my 2015 tax return.

I filed my 2015 taxes as marriage filing separately. I wasn't able to E-file though, you have to mail your tax return in and my refund took over a month to get.

I don't care too much for when I get my refund. But I think they want the 2015 because its past the regular due date of April 15th.

Our reason of the expedite was based on the effects that we faced in Fiji after the cyclone (Winston - Category 5.) I believe you can go ahead and try requesting for an expedite now - the quicker the better!

I listened to your advice and asked for an expedite.

How soon did you hear back from NVC with the expedite decision?
