Denied K1 thinking to do CR1 (split thread)

my k1 visa was recently denied and after monthly administrative process i got email by saying that after reviewing evidence consular do not think that beneficiary will intent to marry in us within 90 days period. they sent petition back to uscis .


we had done religious ceremony in india in hindu temple but didnt do court marriage or any regitery which make marriage legal and they show me our ceremony pics and asked if we married, my response was that it was religious ceremony thats all we didnt have any registry or court marriage.

she is my fiancee .

then they made me to write and i wrote there that we had traditional marriage ceremony in india in temple on this date ...

now we are thinking to do court marriage in india and then apply for cr1 .

but we are unsure about it , worried and confused what is the right path ?..

any similar situation or any body who is on same boat?

that is very sad ...m sorry for you....but from where,did they get the traditional wedding pics?can you explain in detail what happened there and who was the interviewer and what they said?

Our lawyer sent our pics with Pettition ..

They asked me question about my fiancee work where she lives where her father live

When did you engage ? I was confuse on this point becoz I didnt know what was the exact date of our engAgement

Then they showed our ceremony pics where I said that it's our traditional ceremony pics ..

She said ok and smile ..

I had interview with white sincere lady but later with Indian consulate boy cut hair on window 21 ..

Then asked why u applied for k1I said becoz she is my fiancee we arent married yet legally as foreigner can marry under special marriage act ..

So we don't have any court certificate or marriage

She nodded and said ok .

Then provided me administrative processing slip .

And after one month I got mail saying

After reviewing the evidence provided by you, the consular officer has concluded that there is insufficient evidence of your intent to marry the petitioner within 90 days of arrival in the United States. You are therefore ineligible for a visa under Section 221(G) of the Immigration and Nationality Act.

We are returning the petition to the National Visa Center (NVC). Any further inquiries may be addressed to the approving United States Citizenship and Immigration Services (USCIS) Office.

You have two choices. The I-129F will likely die. The NOA2 has a limited shelf life and the USCIS doesn't bother with them.

So you can go for K1 again or get legally married and start the CR1 process. Many people decide to just get married.

I would just get married again and record it as it seems you are already married it just wasn't recorded.

You committed yourselves in a public ceremony. In many places this is considered being married.

200 years ago most marriages probably were not recorded at a local government office.

A simple Hop over a broom stick was all that it took to be considered married in certain cultures.

our k1 visa was denied I don't know exactly why !!

We are depressed

We had religious ceremony and when consular asked me to show them our ceremony pics I didnt have I said and she didnt lookat any of my document's and put me in aadministrative proccess where after a month I got mail that my visa cant be issued becoz of no intentions to marry my fiancee in 90 days consular see .

And our petition was sent back to uscis .

Last month my fiancee got post mail abou. Decision where they explained that we are free to file 129-f again .

Now we are thinking to do cr1 route and thats what our lawyer explained to do .

I don't know what to do now it seems similar case like you guys had .

I don't know why our lawyer directed us to applly for k1..

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

January 28, 2014: Production of new Green Card ordered

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
