I'm new here so I apologize if this is in the wrong place. This site is huge and a little overwhelming on first visit. Anyway, I've looked all over Google and can't find an answer so I joined here to asked.

I am living in Tunisia with my husband right now. I'm working on filling out the i 130 form to petition to bring him to America. What I'm confused about is if I can go ahead and send the form i 864 with this and also for the joint sponsor? Everything I see online is addressing sending these together with an adjustment of status which doesn't apply to us. Will sending it save us time or will they just ask for it again when it is sent to the NVC?

Also I am aware that my i 864 won't be valid if I don't have US domicile. I still have a mailing address in America which all of my credit cards and bank statements are sent to and I can get a letter from my mom stating we will be moving back with her upon returning to America. I can also write a paper stating that I am only intending to live here until my husband is able to join me in America. I'm pregnant and he doesn't want to miss the pregnancy and potentially the birth of his first child. Will this be enough or is there something else I should do/get?

Thank you for any help you can offer.

The I-864 is first used when the case gets to NVC, so no need to sent it with the I-130.

They will not use the information there.

Don't send the I-864 now, it will confuse the USCIS staff and they may throw it away, plus NVC will request an up-to-date one anyways.

It is absolutely fine to live with your husband during this important time for your family, and since you have a co-sponsor, should not be a problem.
