Dear Friends, Hope you all are fine.My brother has been married with US citizen for more than 2 years. Few weeks ago my brother got F21 Visa from US embassy. Actually, my brother is going to give divorce to his wife. He has not travelled to USA yet. Some people say that wife can put request of visa cancelation. Some says it is not possible because marraieg is now more than 2 years old. Can anyone tell that, in this situation, can his wife cancel his visa??

Do you mean he got a IR-1 spousal visa? Because that is the visa for the spouse of a US citizen married more than 2 years.

The visa is for family re-unification, so if there is no family, there is no need for the visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

F21 ? Regardless, if the uscitizen spouse is primary sponsor on i-864, then she can cancel that form, which will cause the visa to be invalidated.

Dear Friends,

The IV catogary that is written on visa is F21. They also gave a enclosed packet whish is suppose to give to Immigration at the airport. After that, they will send 10 years green card in 90-120 days. Most people say that spouse cannot put visa cancellation request after 2 years of marriage, but some says she can get it cancelled. I am confused on this. Even if she can put request of visa cancellation, how can immigration department accept it without any evidence? Can anyone has seen such case in which spouse cancell the F21 visa before arrival to USA?

Listen to yourself.

HE PLANS TO DIVORCE HIS WIFE. It would immigration fraud for him to use a spousal visa when a bona fide marriage does not exist.

Why would his wife want to be on the hook for the I-864 for a man who will divorce her as soon as he gets his green card through her?
