If you have the money, applying for a tourist visa is worth a try.

All they can say is "no", and a denial will not impact the spousal visa as long as there are no lies.

I guess it will not Him having a job is not good, I do understand what they will say. But he will not overstay we are in the process of having him come live here legally, and we will prove that we are doing that, i think it still won't work

I don't think there is anyone on this site that doesn't wish they could be with their fiance/spouse during this process. Unfortunately, for some countries, particularly third world countries visitor visa's are very difficult to obtain. Partly because there is a belief they won't return and partly because some granted visitor visa's overstayed, etc.

Don't even waste your money. They will take it but if he has a wife (New wife from the way you wrote it it) he has nothing tying him to JA. A job is nto a strong enough tie. My husband and I are int he same situation. He has a good job and has been for years but we both know while there is immigration paperwork being processed they willing to grant a visitor Visa. Sad how tough it is for newlyweds to just be together because some time in past others did the wrong thing

Well, Rochelel just last week you stated you was getting married 2/5/2016 so, it maybe best if you guys are in this for TRUE to apply for the K-1 Visa and go thur those steps but, to apply for a B-1 Visa isn't worth the time. Each visa will take time so just decide for yourself and your future husband which will be best for the two of you. Good Luck!
