Hello VJ Family,

I recently went to the Social Security Office to get numbers for my husband and son. They refused them numbers because they did not have a birth certificate even after we showed them the passport and Visa. the original birth certificates were in the Visa packet and at POE they would not give them back stating they are property of Customs. After looking at the advice on how to obtain a SSN it does not say a birth certificate is needed for a SSN. the lady said that they need one because they never had one before. We are in the process of getting theirs again from Jamaica but God knows how long that will take. Also I am confused about an I 94. I typed it in on the website but no records were found for my husband. What is an I 94 Can any one tell me if this is correct, that a birth certificate is required at the SS office?

the struggle continues!!

Oh one more thing. at what point will he be able to get his drivers license. after he gets his green card. He is driving under his Jamaican Drivers License now but not sure how legal that is but figured hey if he rented a car, they would use his passport and Jamaican DL so why not.

anyway any advice would be helpful.

Another question is for the AOS Affidavit of support, how many years back in tax transcripts do I need to send in. decided to ask all at once so as not to start so many topics. sorry for being scattered in my questions in advance and thanks for your help

Multifaceted questions moved from General Immigration Discussion forum to the "Moving to the US & Your New Life" forum, where some or all of the issues can be discussed.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes! that is what I thought also. It is crazy that they don't all have one single process in place. I may try to just go to a different office and bring some literature with me from THEIR website. Ok nice to know. about DL too

They required original birth certificates for both him and his son. I only sent a copy of mine with the petition but they needed to have originals at the interview no exceptions!!

Yes for almost 80 dollars a piece. I have already wired money to his aunt to get them in 3 weeks and mail them to us... SMH

I have been warning people that your spouse or fiance needs to get 2 original birth certificates. One for the interview and one to bring with them to the USA. You do not get the documents in the packet for POE back!

I do know one person who was able to retrieve their original birth certificate from that packet, but they had a very difficult time and it took quite awhile.

Hope everything works out for you Lala! I know you got this after what you've been through!

OK so I will try a different office for SSN's and take him Down to DMV for DL test. Any answers on AOS i94 what that is and how many years worth of tax transcripts to satisfy i864

You need to print off the I-94. You need it to take to the SSA along with passport to get the SSN. You also need a copy of it for AOS. > https://i94.cbp.dhs.gov/I94/consent.html

If it comes up 'Not found' > https://help.cbp.gov/app/answers/detail/a_id/1697/kw/I-94%20not%20found/

Need to list the last 3 years of Total Income from your taxes on the I-864, but only the most recent transcript is required to be submitted. Take a look at the form and its instructions. You should also add in proof of your current income. Also, check out the AOS forum here on VJ.

Then what? Then what??? C'mon, KDC! The anticipation is killing me!

I think our I-94 came up within one business day (because the day after his arrival was a federal holiday). I hope we are able to see our case on SAVE before we apply for the SSN.

Hopefully you can find your answers before the holiday next week, Lala!

Yep, i needed a BC for my SSN. I also needed it for when I got my marriage certificate.

Are you sure that you're filling out all the information correctly? I was able to pull up my I-94 two days after I landed.

I'm almost 99% sure you can file for a DL once he gets his EAD. (I'm not sure though if the K2 gets the EAD before the greencard like the K1 applicant does).

My co-sponsor only showed about 3 years of tax returns. :)
