Hi everybody,

We are filling out the I-864 Affidavit of support. My husband (USC) filled taxes for 2013 but the income doesn't meet the requirement. He also filled taxes for 2014 and the income meets the requirement for that year, so I guess we are good with this.

We got confused yesterday evening while we were filling this out so here are some questions:

- So in the form, they ask to attach a photocopy of the Federal income tax return for only the most recent year. It would be 2014. My husband ordered the tax return to IRS and they sent a form called "Form W-2 Wage and Tax Statement". Is this the document we have to send with the I-864 form?

- Then, in the I-864 question 19 - 19a - 19b - 19c, they ask for the total income for the most recent 3 years. We will just give 2013 and 2014 - is that ok? Do we need to send the copy of the tax return of 2013 also for this question? He doesn't meet the requirement with the 2013 income.

- In Part 7, question 6 of the form, I can enter the amount of the sponsored immigrant's savings and checking accounts. If I have a good amount of savings, can I just enter the number and send a copy of my bank statement? Does that help to prove we can support ourselves?

- If you are attaching a copy of entire federal tax return then you also need to provide W2s. If you order IRS tax transcripts from here: https://www.irs.gov/Individuals/Get-Transcriptthen the W2s aren't necessary.

It sounds like you ordered copies of the W2. What you should order is the tax transcript.

- Yes, that's fine. For 2012, you'll need to put N/A and attach a letter explaining why you didn't need to file taxes for 2012 (unemployed, student, low income, etc.) Sending the 2013 tax return is not necessary. You just need to put the amount on 19b.

- If your husband's current income is enough to sponsor then it's not necessary to include information about the sponsored immigrant's assets. If you still want to provide this information, you can enclose proof of the assets (i.e. bank statements, letter from the bank etc.)

Teeak, Thank you for clearing that up for me also because, it is totally confusing. I too am filling out the AOS application for our application along with an co-sponsor which is my mother. We both went to the IRS and got the tax transcripts for 2012, 2013 and 2014 and was confused if we needed to send the W2's as well. Whew! Thank you so much dropping application in the mail today. ​

Thanks for your answers.

Actually the form we have for 2014 is called "Wage and Income Transcript" and then it says "Form W2 Wage and Tax Statement" so I'm still not sure if this is the tax transcript?? We got it by calling IRS.

When I try to order online online on the IRS website, I get this message: Your request cannot be completed. Please contact us at 1-800-908-9946, our automated telephone self service, to order an account or a return transcript.

Should I try to order a tax transcript again or are we good with the form we already have: "Wage and Income Transcript" and then it says "Form W2 Wage and Tax Statement" ?

Hmm, the ones we submitted were called return transcript and they didn't say "Wage and Income Transcript" on them. You also have the option of going to your closest IRS office. They'll give it to you right away when you go in person.

Instead of submitting the transcripts, you can also submit the entire federal tax return and a copy of the W2s for 2014.

Can get transcript at local irs office, also. Must walk in using feet, talk with human using mouth.
