It makes no difference whether they receive the combo card now; they departed the US without AP, and so their I-485 is automatically denied as a result of that.

ok, here is me again.

I will probably get more not so good news from you guys :).

I went to see lawyer today, he helped me get TN VISA last year.

However, he is not available too busy representing client at the border.

Meanwhile, I cant sleep not eat, and stomach churning.

Just thinking of the security that I am providing now for my family, phew going and going.

Here is the brief history, again. with the hope someone will will give me a flicker of hope suggestion.

File for AOS on Sep12.

Request RFE for I-485 received Nov 9. Page was missing, and a stamp at the bottom saying "Action Completed Approve for filing " dated 10-31.

Replied Nov 14, and will not get to USCIS till Nov 19 according USPS.

My bags are packed now ready to head to the border, I strongly believe that POE does not have record of my application since I just replied RFE for I-485 11/14, and will not get to Missouri till 11/19.
What if I risk it and head to the border, and with a lot of prayer, I can get in on my current TN and save my job and security for my kids.
Then down the road if they ask, have you traveled out since filling, I can technically say "No, not since last filling Saturday 14th of November".
All these dependent on if I get in.
I also believe that USCIS does not have my departure record because:

1) I departed October 18th via road, and the RFE for I-485 letter was dated Nov2.

2) The Official Web Portal for retrieving I-94 is still showing September 3 for arrival and departure.
Maybe I am just overthinking this because of lack of sleep.
Maybe I should listen to advice from this board, withdraw current application and apply for CR-1/IR-1. Does anyone know how long this take in Canada?
I am conflicted beyond believe.

CR1 will take the same amount of time for any country (USA processing-wise. The embassy portions can vary). Took us 9.5 months with an expedite at NVC and about $2,000 or so if I remember correctly.

You're asking if it's ok to lie to USCIS. The answer is no.

What you should do is not in doubt; the only question is what you will actually do, and that's up to you.

As I said above, if it comes to light in the future that you concealed a material fact then this can result in a lifetime bar from the US (for material misrepresentation). Any green card obtained through fraudulent means can also be revoked.

I like this news though - "stay in Canada until you get your combo card, you won't be able to entry the US inasmuch as you are already in the system =("

That settles my stomach a bit. lol.
Maybe I can convince my boss to let me work remote till end of Feb 16th.
He like Canadian Bacon and Cheese. Maybe I will send some down.

I was trying to enumerate my timeline for better advice.

Again, I dont intend to lie or cheat the government.

My lawyer finally recommends withdrawal of application which is the route I will be taken.
