PETITION For mom only (possible problems, please help!!)

Hello All,

To the moderators, please feel free to move my post to where it belongs. I can't seem to find the forum for regional-related or country-specific question - Philippines

1) I am getting ready to file for my petition for my mom (not petitioning for my father), and I happen to have an extra Birth certificate copy from the NSO, and I noticed that they have put in a marriage date, which i believe never happened. I never cared, but as I asked my mom about it, she said it was all for legitimacy purposes that I may carry my father's last name. Question: How do we go about this? Considering I have no plans on ever petitioning for my dad, will my mom be asked for her "marriage certificate" anytime in the process? like maybe during NVC? or interview? Please enlighten me!

and by the way, my mom used her maiden name as my mother's name on my birth certificate despite the supposed fake marriage date.

2) My mom's name on my birth certificate doesn't quite match what's on her birth certifcate. Her name in the registry for birth or in NSO, is Maria Mitzi but on my birth certificate, she only used Mitzi as her first name. How do I do move forward? As I research on that RA 9048 or whatever that is, we're leaning on getting her birth certificate corrected to just using Mitzi, in other words, omit the Maria, to match what's reflected on my birth certificate? Is this the right thing to do, or is it my birth certificate that needs corrected? If my birth certificate needs correction, as well as correcting this "fake marriage date" they put on my bc, how will that affect me now that I am a US citizen? please please, i would appreciate if my fellow filipinos would chime in to help me on this one! Thank you!

Hi, I ran into quite similar issue when I was about to start the petition for my dad. I called the USCIS of what I needed to do before moving forward. The customer service told me to schedule an appointment to see and have a talk the local immigration officer in your area. Which what I did. I was told as long as you can prove a biological relationship to the beneficiary, that's all they care about. So I suggest with your case, to get an appointment to talk to your local immigration officer of what you needed to do before moving forward. You can book the appointment via uscis website.

What are the steps you provided to prove biological relationship since there's typo error in the BC? like photos?

I have a same issue like yours I always known my mom name is Susana then I look in my bc it was Susan then good thing she doesn't have a birth certificate. we get her a late registration but the bad side of it soon as my mom will be here and petition my siblings my mom's name in their bc was Susana so I told to my mom fix it they went to city hall were we live In Philippines fix the issue and submit some document they ask. and in my father side of story completely different I didn't petition my father yet. still fixing his bc before I will petition him his name in my bc was completely different name and last name. example his name in my bc is juan dela cruz but when he went to get his bc it was pedro panday he didn't know he doesn't have a clue why its different he ask his autie where he grow up with they tell him his grandparent change his name since he was adopted by his grand parent now its been years we fixing his bc from pedro panday to juan delacruz and lot of court hearing and cause a lot of money for me hotel and plane ticket back and fort every hearing since they told us he can't fix his bc in manila he has to fix it the place where he was born. he already had hearing pedro panday and juan dela cruz is only one person affidavit and explain what happen good thing that his auntie he grow up with as a siblings still alive as a witness. now I just waiting for courth final decision and hoping processing in phil become faster so I can petition my father soon.

for me better fix it before you petition your mom. and bc problem in Philippines is very common lot of error I have a friend very same issue like yours her mom hired a lawyer to fix her bc they paid 50thou.alam mo naman pano tumakbo pinas pera ditto pera duon but its was fast. mine didn't hired a lawyer I just told to my parent go to city hall and figure it out how to fix their bc.

I am a LPR and already submitted my N-400 for citizenship. My husbnd wants my mom to come for a visit but she had a problem on her name. She got 3 different names on the 3 documents:( but the names we used since birth is Yolanda which is not on her BC and Baptisma Cert. Anyone has the same problem with me? Please I need an advice on what to do about this and thank you in advance.

My mom's situation is sort of similar. The name she has used since she was a child does not match the name on her birth certificate so we are working on getting the name on her birth certificate changed. NSO told her that it could take 4 months, possibly less. Is there any way your mom can have 2 of the 3 documents amended to match?

The best place that you should be is on the website for PSA (formally NSO). https://psa.gov.ph/civilregistration/problems-and-solutions/birth-certificate

They have an extensive FAQ for all kinds of name problems. Your problem can be answered there. Take the time to do some research folks.

In my mom's case, we decided to change her name on HER birth certificate to match her name on MY birth certificate. Thankfully, it turned out to be the same name that's on most of her other documents. The only ID that doesn't match it is her passport which I assume will be easier to change once she has her corrected birth certificate.

What visa did you enter the U.S. on? Which name did you use for your mom when you filled out your USCIS forms (if those forms asked for mother's name)? I would suggest changing her name to whatever name is listed in your USCIS paperwork. In my case, the name I used for her is the name that's on my birth certificate - from the I-129F (G-325A) to the I-485 where it specifically asks for mother's name.

I came here using the K-1 visa and used her name as Yolanda since that's the one indicated on all of our birth certificates and other records. We've been using that since birth. Since her birth was not registered, the local city health on our place said to go to where she was born and get her baptismal and maybe start from there.

That sounds like a good plan! If her baptismal certificate also matches your birth certificates, I think that would make it a lot easier to change her name to Yolanda - more evidence that it's the name she regularly uses.

I do think it would be a lot easier to change her name on her birth certificate than having to change yours since you're already in the U.S. and you've already submitted her name as Yolanda to the USCIS on your own documents. It would just be easier to prove that the person you are petitioning is the same person that you indicated as your mother on your USCIS paperwork.

BTW, I suggest getting this process started right away. I see that your N-400 is pending and since the petition for name change in the Philippines may take up to 4 months, you should get it started so that if you want to petition your mom right away after you become a U.S. citizen, you might not have to wait until her birth certificate is corrected before filing (she might have it corrected by the time you take your Oath :)).

Yes, they said they will go to the NSO office for a late registration but still don't know what would be the requirements for that since her baptismal is sure had a different name on it, we don't know where the hell she got that Yolanda name...LOL but hopefully we will get a good feedback on it so we can do what's right.

I also read a forum here that said to call the local USCIS office and ask regarding those kind of concerns., but still want to fix her name there in the PI so everybody can benefit from it. It just sucks how long and how costly over there to fix those problems.

LOL! That's how I felt when we found out that my mom's birth certificate had a different name XD "How did this happen?! Where did that second name come from?!" Apparently my grandpa was the one who filled out the form and didn't know that my grandma wanted my mom to have the two names. She insisted that my mom use those two names so it ended up on all of her documents. Makes you wonder why people didn't question it when she showed her birth certificate and they saw that it didn't match. But I guess they just don't scrutinize documents like we'd expect them to. <_<

So far the amount they quoted my mom seems fairly reasonable. BUT they did want her to get 2 copies (or maybe it was 3?) of everything - which is anywhere from Php315 (Birth/Marriage/Death Certificates) to Php415 (CENOMAR) per copy... it adds up >_< So far I think the amount is around $200 but there were fees that they mentioned but didn't tell her how much yet. :( I'll keep you posted!
