Hi Everyone,

My husband and I are filling our AOS and we are a little confused on the supporting documents required for I-864. In the instructions it says:

"You are required to provide proof of employment and a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year. If you were not required to file a tax return for your most recent tax year, you must provide an explanation"

I am confused as to what the 'complete federal income tax return' is. I thought it was the W2 but the instructions go on to say that the W2 is seperate from this. My other thought was that the federal return is the refund you receive from the government after filing taxes, but I received only a direct deposit back from H&R Block so this can't be right either.

Can anyone help?

The federal tax return is the form 1040. You have two options, if you have them send photocopies of your 1040, W-2(s)

and any other IRS forms you filed with your last taxes, or you can get the IRS to give you a tax transcript and file that with your I-864.

So is this just the forms that I sent to the IRS, I sent mine online so I just print them off and use them?

I have the form 1040 that I sent to the IRS, just isn't signed as it was done online but still has all my tax information

Yep, I do my taxes online and that's what I sent to USCIS. The printed out 1040, plus photocopies of W2 and 1099s.

What is a 1099? Does everyone have to have it included in the Affidavit of Support? My fiance says he doesn't have one and never had to file it.......not sure what it is for to start with. Thanks.

June 19/07 - Day 90 ......nothing (Hubby calls Senator's Office)

June 20/07 - Day 91 - Got the "70 Day Letter" in the mail today :-(

June 22/07 - Mailed out EAD and AP by Priority Post Day 93

June 24/07 - EAD rec'd at Chicago Lockbox

June 29/07 - Day 100 - Infopass appt in OKC..... AOS stuck in name check

July 3/07 - Day 104 - Rec'd NOA for EAD

July 6/07 - Day 107 - Rec'd letter for EAD Bio Appt. for July 18th

July 18/07 -Biometrics

A 1099 is like a W-2 but for other forms of income, for example I have 1099s from earing interest on my savings account. If you don't have any, don't worry about it. Its not a form you fill out yourself.

What you might want to do is order tax transcripts from the IRS so that there's no worries. Some people who have sent in W-2s and 1040s have gotten RFEs; it isn't clear if that's why. I'd also recommend you file and send a copy of your 2006 taxes as many people who filed at this time last year got RFEs.
