Hi there,

I am preparing all of the documents that i need to file a petition for my wife and stuck with the question about the minimum income requirement and also what will be considered as a legitimate income source?

I am a US citizen with an income sources from W2, since i have 3 kids with my wife, so we fall into the category Family of 5 and the minimum income requirement is $35,512

with my own income, i won't be able to meet that requirement ( my income a year is $30K ) but my wife has an online business income like : ebay, amazon ( those income doesnt require her to file the income since it never hit $10K / year)

Can i still use her "undocumented income" to add to my yearly income so we can meet the minimum income requirement?

will they consider that as our family income? we have the prove of income from ebay or amazon stating how much money that we received in details, will that help our case or it will actually hurt our case since we were not reporting the income?

Any input or advises?

That's not a salary but business income.

Are you thinking that she can prove net income of $6000? If she isn't an LPR or US citizen she is not required to report the income. Once she is, then she reports it.

I would suggest getting a joint sponsor that meets the income requirements for their family plus any intending immigrants.

Are you thinking that she can prove net income of $6000? If she isn't an LPR or US citizen she is not required to report the income. Once she is, then she reports it.

I would suggest getting a joint sponsor that meets the income requirements for their family plus any intending immigrants.

yeah, we have the prove income from online,I've been trying to ask around and see if there is someone who can be a joint sponsor for her but still cant find one who meet the income requirements and able to help.

my idea is to file my 2015 tax and include my wife's income in it so our household income will meet the requirement and then submit the petition for her.

do you think that will be a great idea? ( the downside is i will have to pay the tax amount on her business income but if that can help us meet the requirement then maybe thats the best way to do it)

If you're filing married / joint you have to include her income whether it's a dollar a year or $6000 a year
