Isn't it that the name you used in Adjusting your Status is the"legal way to change your name" here in the U.S.? I have no idea that there is a law or rule here in the U.S. In choosing what would you like to use in your maiden name when you get married ?

If this is for me, I got married in the Philippines so when I updated all my information before I left, I followed the PH rule. I didn't have an idea that US follows different rule until I moved here.

My sister got married in the Philippines and filed a spousal visa, there were no issue about it. She was able to use her Maiden Last Name as her Middle Name.

Regardless of…. I won't be using my Philippine passport visiting the Philippines. I will wait for the Citizenship then it does't matter anymore, my passport will be the same with any of my ID's.

I am probably with you there! Though I will get dual citizenship but might not end up using my PH passport. PH passport expires every 5 years and it is hassle to go to the PH embassy just to renew it. Though all my ids here and in PH are all in my legal name. My only trouble is people here usually put my second name as my middle name so I just have to remind them all the time I have two first names lol.

Thanks for the link! =)

Here what I found, but what kind of "Appropriate legal documentation", we need to justify the name we want?

Name Changes/Naming Conventions

Question 3: Certain field offices appear to have instructed officers to either require or recommend that female married applicants take their husband’s surname, their father’s surname, or drop part of a hyphenated surname upon adjudication of an I-485 or N-400. In at least one case, the name change resulted in the individual having various problems, including difficulty enrolling in school. According to the USCIS Adjudicator’s Field Manual, chapter 51.4(a), “[a]ny USCIS document is to be issued to the individual in his or her full legal name,” and “[a] married woman may choose a legal married name (husband’s surname), a legal pre-marriage name (retention of maiden name), or any form of either (e.g., hyphenated name, maiden name and husband’s surname)” if supported by appropriate legal documentation. Please issue a reminder to the field on current USCIS policy in this regard.

Response: A reminder regarding this issue was previously provided to the field. If there are offices that are still not following the direction provided in the Adjudicator’s Field Manual, please bring it to our attention.

We were married here, from K1 visa and I'm in the AOS processing, I applied my AOS under my husbands surname as my last name and my maiden name as my middle name, because I know that in ph rule, taking your last name (when you were single) to be your maiden name when you get married. Fingers cross that the IO will not intervene with my names during interview or green card production.. Lol! Very conflicting rules from one country to another. ?

Any feedback on whether or not using the Phillippine naming convention for married names is causing issues with AoS?

In California, you're legally allowed to specify the Phillippine-style name on the Marriage License with no problem.

Really stressed about this now.

Good day!!!

We were married here in US under K-1 Visa. In my marriage certificate, I can`t used my maiden name as my middle name, i.e.

Single : Jenny Jane Bitayo Rosal
(first name) (middle name) (last name)
Married to: Charles Swain Volkstorf
Married Name: Jenny Jane Rosal Volkstorf
(first name) (new middle name) (new last name)

Marriage Certificate:

Jenny Jane Bitayo Volkstorf
(first name) (middle name) (last name)
I am planning to use the names in my marriage certificate and once the green card is issued, I will file a petition for a name change following the ph rule of name convention. Is that possible?
Please do reply.
Thank you.
Jenny

I don't think I ever updated here, but we were able to complete the AoS without any issues using the Philippines naming convention. After all the stress, that process ended up going very smoothly. This may still vary state-to-state. My understanding is that Tennessee allows changing the middle name upon marriage, but some states may not. I do not know if this has any bearing on acceptability of the name.

Hi there. What happened to your AOS application? I'm from the Ph and will file my AOS soon and now facing the middle name issue.

When I sent my application for aos last month, I used the same way as what we do in the Phils, that is, first name, middle name (maiden name), last name of husband. When I did my biometrics yesterday in Tennessee, they told me I couldn't use my maiden name as my middle name. Instead, I should retain my old middle name (mother's maiden name) coz that's how it is in the US. They said I could change it to whatever I want to whenever I become a USC.  I'm so confused right now coz I already have my SSN and it uses my maiden name as my middle name. And I have to renew my PH passport next yr. Anyone who's having the same dilemna? Thanks guys

We ended up going with the normal Philippines naming convention.  We had no problems.

I had my Greencard on Dec.2015 with my First Name, Maiden Name and Husband Last Name.  Until now I did not change my name in my SSN card yet which I'm not sure what will happen.

I guess it depends which State you are in.  It is really a big issue for us Filipinos.  I reported my married to the Philippine Embassy in San Francsico with my First Name, Last Name, and Husband Name so there's already discrepancy there.  And I still have my passport in my Single Name and Last  Name which will expires on August 2018.  While my Citizenship need to be filed on October 2018.  So there's a lot of confusion on my side too.  So i just decided to dismiss the idea of changing my name at the moment until I get my Citizenship card and I was told you can change your name for FREE and however you want it.

I'm just hoping, we could here from our fellow Filipinas who had the same experience.

Sorry I am not a big help right now.

Cheers,
