TWO YEAR TIME FRAME FAST APPROACHING

My brother would like to apply for his fiance in Guyana, South America. However, he last saw her 11/21/2013, can he still apply and fall within the time frame of meeting in the last two years as long as his package arrives by 11/30/2015 or will it be too late. He''s visited her a number of times before and can prove a relationship through their ongoing communication, but he would like to know how does USCIS count the two years. I helped him with the package and he's waiting on two pieces of information to arrive from his fiancee in the mail, he should be able to send the package to USCIS on 11/21/2015. He was without work for most of 2014 and recently found employment in 2015 that's why he wasn't able to visit her.

from what I understand he would have to file by 11/20/15 to meet the requirement.

Oh no, if he proceeds and apply, from your answer he'll more than likely be turned down, will he have to file a new I-129F after visiting or will he only be required to submit a boarding pass or airline ticket as proof that he saw her after 11/20/15

He would have to file a new I-129F. He has to meet the requirements AT the time of filing, he can't file and THEN meet the two year requirement and show proof after filing. Proof of meeting in the last two years has to be included with the I-129F package that is sent.

Ash is correct, you have to meet the 2 year requirements at time of filing. He is better to not attempt to file now and go see her again first.

Okay, thank you guys for your comments, I'll advise him not to file until he meets her again.
