I think it's important to note that the statistics are from 2008 and also these are the people that were denied visas. In your example of 21% for misrep, that percentage only includes those that went further to actually apply for a waiver. If my thinking is correct, 79% were initially denied visas at the interview, then they had an option to file the waiver. Out of those that applied and were denied, 21% of the total were had approved waivers, they don't exactly give the statistics for those that chose not to continue the journey and how much that percentage made up of the 79%. I would also be interested to know where they are pulling information for statistics from, because I didn't see a reference.

I also make this distinction because there is a such thing in the USCIS policy manual called "harmless misrepresentation"- meaning misrepresentation that they can still deny you for although it was not material. Those cases would not need a waiver but could be denied for the "harmless misrepresentation", which could account for the chunk of 79%.

This is the “When you lie, you fry” category. These were immigrants who had their visas denied due to being caught committing fraud or misrepresenting (lying) some fact in order to obtain the visa or even any previous visa or admission document. The relatively high denial rate shows that U.S. immigration authorities do not have a high tolerance for immigrants not being truthful on their applications. Still, 21% of them ended up overcoming this due to a waiver being available. The waiver is to show extreme hardship to a spouse, child or parent who is a U.S. citizen or legal permanent resident and thus, is quite similar to the waiver used for the very common 10-year bar, which is the next category.

I read it as "them" being the 79% denied cases who went on to file a waiver and 21% of them were approved.

Why do you feel the statistics above from the link I posted are lies ? What about the statistic of approval you mentioned, does it have a link

What similar issues is the OP addressing ? She did not state the ineligibility here in this thread so I do not know what the issue is.

What many things ? I used the example for misrepresentation. Then add to that the difference of material and immaterial misrepresentation and

it is another picture, one needs a waiver and one does not. Which one does and which one does not, though black on white on paper, it is grey in reality

and open to discretionary interpretation.

If you read the link you will find 10 different inadmissibility reasons and each with different approval rates which OP can pick her issue out of.

The 2 different sources I posted, one approval rate of 21% (attorney) the other from USCIS 22% so I do not think they are lies at all.

If you have stats on specific waiver approvals please post them for comparison. As I said every inadmissibility shows a different

approval rate and there is a different in provisional and the non provisional waiver approval rate.

Lumping them all together does not give a clear picture, separate them and it gives a more accurate estimate and that was the point I was making.

Let us keep the maths simple and say that 1 in 4 misreps waivers are approved.

What is the definition of misrep? Does it include false claim to US citizenship which is not waiverable for example.

Misrep can cover a wide range of issues, now if what I am assuming is the case then this is not down the bad end.

Then as I mentioned there is the quality of the waiver, I have heard of waivers being approved for overstays that did not seem up to any standard, my assumption is the back of the ** packet approach is less likely to succeed on a misrep.

So for a valid comparison you would need the stats for a well written waiver packet, and a comparable mirep, I am assuming the former will apply and the latter is mild.

I can understand your confusion as of course what you are saying is logical, should not matter what the presentation is.

But not how it works in practice.

It is a bot like passing an exam where the marker is looking for certain key elements to tick the box. They do not care about the totality, they are just grading a paper, did your presentation tick enough boxes.

From the many many cases I have seen the variability is in the presentation, not the extent of the hardships.

It's not that I am the one confused but would have a hard time coming up with genuine hardships today as I have been doing well by myself and would not be dependent on a fiance with anything.

One can tick boxes and make a mountain of a mole hill but frankly I would not have financial, medical, family,

physical or whatever hardship. Coming up with hardship levels is one thing but proving them with well thought out evidence is critical according

to waiver attorneys. Perhaps we are saying the same using different words.

All the OP can do is try her best with consulting a good attorney and hope it will work out.

I think we are moving off topic since OP just wants to know about personal experiences with waiver outcome since the topic title was changed.

Though I started a misrep waiver a very long time ago for a different beneficiary, my experience stopped short of sending it due to my enlightenment

that he was not worth my time anymore but I remember the extensive research I had done preparing and consulting. It was a thick package.

After speaking with a lawyer that wouldn't even take our case, consulting with a well-known immigration attorney, and many months of research on waivers, my fiance and I continued to put our faith and hope in the sovereignty of the Lord.

Only by the grace and mercy of Jesus Christ were we approved for our K1 with no need for a waiver.
