Hey everyone, My name is Craig. I am 24 from London. My SO is Shari and she is 22 from Oregon. We have just got engaged after knowing each other for a year. Shari was here in England for 3 months on a study abroad programme and I have just got back from my first trip to the states.

I have many many questions but I am going to take the time to read some more of the site before I start bothering you all!

Just for info purposes I am planning to move to the United States and get married there.

So I am going to get reading and come back with some questions if thats ok?

Aww thanks all for the warm welcome. It is appreciated.

One problem we have had , through talking to many people is once we have married in the USA, I've heard that I have to return to the UK to file my documents and am not aloud back for anything up to 1 1/2 years? Can anyone clarify this please?

10 year GC Approved - APRIL 16th ,2009 - Peggy and Jonathan's......

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

You have a few options

Check out the Guides Visa Comparisons and then have a look at what is necessary in filing the different petitions and accompanying documents/evidence in the following K-1 - K-3 - CR-1

1 1/2 years :no: not quiet that long in general. Check out the timelines HERE for a an indication. A lot also depends on which service center you will be filing through. Oregon is Nebraska. You can check on the latest processing dates HERE. I-129F for fiance is processed at NSC (nebraska) I-130 is sent to NSC but they are forwarding to CSC (california) so the california processing date applies. The I-129F for spousal if you wish to go the K-3 option, is processed at the MSC/NBC (Missouri)

Hi Craig and welcome to VJ !!... Where in London are you from. ? I left the UK just over a year ago after living in Harrow, NW London for 20+ years !!

definately take a look at the guides section you've been pointed to above.

With regard to nt being able to see your Fiancee until your visa is issued you are under the misconception that until approval you cannot visit. This is NOT true !!

Living in the UK there is nothing to stop you attempting to visit the US during the visa application process using the Visa Waiver Programme (VWP). I made 2 visits to the US after we had submitted our application and had no problems at all. As long as you travel with significant proof that you fully intend to return to the UK you should be fine. I took plenty of proof with me and never actually got asked to show any of it. There is ALWAYS the chance that you could get turned around at sent back due to your increased "immigrant intent" but I would say that most people from the UK who have attempted to visit the US while their visa application is being processed have done so with little or no problems at all.

In addition there is nothing stopping your USC Fiancee visiting you in the UK !!

Edited to add:...

There is a period of time after arriving in the US and getting married during which foreign travel is not allowed. The length of this period of time depends on if you decide to apply for Advance Parole (AP) or not in conjunction with your Adjustment of status (AOS) application. If you apply for AP you could be free to leave the US for a trip back to the UK within a few short months. If you choose not to apply for AP you won't be free to travel back to the UK until your Green Card has been issued at the end of the AOS process. This process can take anywehere from a few months to a couple of years to complete depending on the processing speeds of your local office.
