Hello everybody,

You all have been very helpful throughout this entire journey. I got my "green card" valid for two years. It is conditional because it is through my husband.

Now, I have another question!!! :)

Back in August, I obtained Advanced Parole to be able to leave the country on an emergency case (visit sick family member who passed, also continue my medical residency overseas) while my case was pending at USCIS. My Advanced Parole requires me to be back in the states before December 20th. As I mentioned earlier, part of the reason why I got advanced parole was to pursue my medical residency overseas. It is two year program. In the meantime, USCIS processed my case and mailed my green card to my address in the states 2-3 weeks ago. My husband now has my green card. I am currently overseas in residency program.

My question is: Do I still have to come back in the states before December 20th to fulfill the advanced parole requirements, or does having a green card make the advanced parole loose its effect? Obviously, I am planning on coming back to visit my husband soon here, but I would rather not come in December, come in February or so.

I thank you all for all your help or suggestions as to where I could get a right answer in this situation.

Hi,

A green card is for living in the US, not for visiting your husband as you stated. LPRs do not visit the US; they are required to live here.

If you want to be outside the US temporarily for longer than 6 months, then you should get a Re-Entry Permit. This requires a biometric in the US.

Best of luck

Aaron2020,

Thank you for your response. Yes, I agree with your explanation of what LPRs are to do....

It is temporary that I have to be outside of the States to finish my medical residency program. And throughout the program I am planning on visiting my back in the States every 4-5 months. Which will not require me to get a Re-Entry Permit.

My main question is about the advanced parole, to find out if I still have to in the country before December 20th or not.

Thanks

Which will not require me to get a Re-Entry Permit. You may want to Google "maintaining legal permanent residency." It's a common misconception that brief visits to the US is all it takes to keep a green card. You may want to be safe with a Re-Entry Permit rather than sorry. Dr. - a ounce of prevention is worth a pound of cure.

My main question is about the advanced parole, to find out if I still have to in the country before December 20th or not. You do not have to be back by Dec. 20 since you now have a green card.

Thanks
