he lives in Indiana. He pays 500$ per month for his daughter, and if i count it with what he has 1170 per month, then it could be enough if he does not have to pay for her when she turns of age, and gets her own ssi/ssdi. His mother wants to start a cleaning business with me, but we can not do that until i am there. And i got a job offered as a care giver, only if i lived there. And they do not submit work visas, has to be american based only.

what i also do not get is he needs to make the 19,000+ to get me there. But if i want to work he needs to make around the 25,000$ + right? Otherwise on the 19,000+ is just to get me there, but i would not be able to work

No, not right.

With his daughter, his household count for the I-864 would be three; fiance, his daugher, and you. He would need to make $25,112.

Without his daughter, his household count for the I-864 would be two; fiance and you. He would need to make $19,912.

Regardless of whether he brings you as a fiance or a spouse, he needs to hit those numbers for the I-864 in order for you to get a green card.

The age of majority in Indiana is 18. The age when child support ends is 19. His daughter would not be counted on the I-864 when she reaches the age of 19 and your fiance no longer has a legal obligation to support her.

From what you're saying, YES, he would make enough once his daughter turns 18 and he no longer has to include her as a member of the household.

He currently makes 1670 a month BEFORE debts like the child support, which is 500$. So he makes 20040$ a year.

If you did it NOW, he would have to prove he could make 25,112$. Enough money for you, him, and his daughter. He currently makes 20040$ BEFORE debts are paid. Not enough to do right now.

If you did it once his daughter turned 18, he would have to prove he could make 19,912$. Enough money for you and him. He currently makes enough, but barely.



But I have to warn you, he would only make 128$ more than the minimum required, once his daughter turns 18 and is no longer included, and because of it being so close, you could still be refused the visa and asked for a cosponsor.

Him being unable to work and being on disability is a red flag, and it is very likely that the consulate will not accept him because he is too close to the financial limits. In that case they would ask for a cosponsor.

The "requirement" limits are there just to have an idea of what you should make and that it is the LOWEST you can make, but at the interview, the consulate officer can refuse a visa to a person even if they meet the limit, ESPECIALLY if they're too close..

There's still a chance, in two years, if you do this, that you will be exactly where you are now. His disability income can also change every year, if he even gets almost 11$ less a month, he will not be able to sponsor you.

Are you counting his gross income or are you counting what he has left after child support?

Sounds like she is only counting the money he has after child support. She write he has 1170 per month which is 1170x12 = 14,040.

I don't think she knows she have to use gross income to the I-864

what if you try to go on student visa. Try to find a community college in his area that can provide you a student visa. Community colleges are relatively cheap in comparison to universities.

For that to work you need to attend a college that is approved for student visas, prove that you have enough money in savings for all tuition, food, rent etc costs, and also because of having a partner in the us it can be a hindrance. I knew a friend of mine who had all tuition money, was at an approved school, and still got his student visa denied because his boyfriend (now husband) was an USC.

I am sorry that you are in this situation, if i where you, try the diversity lottery, we are eligible for it.

And just my two cents to everyone who says just move to holland, it's an easy solution. It is not, The Netherlands is really really strict on income requirements and other stuff. It would be easier to move to the USA (ur situation left out).

Would not work for several reasons.

1. A student is required to show a home the student intends to return to after completing the course of study. The student can not have the intent to immigrate.

2. Got cash? International student tuition at a community college will start at $5,000 and then the student has to have another $10,000 for living expenses. Can't work first year and limited employment opportunities after that. The Op's problem is not meeting the income and assets requirements of the I-864, so where is this cash for school going to come from?

3. USC fiance.

4. Does not solve the need for the I-864 if OP wants a green card.

For some reason i had to wait before i could respond again. But it seems to work alright.

I know that they want his income to be in gross. The 1170 $ he gets every month is what he gets to his bankaccount, and the money of his daughter is extracted and this is the amount he has every month. And i think that is nett, so if they want it in gross it is only a positive sign i think, or he would have needed to have even more money.


If i could go to college there, then i could wait another year and have the 30,000$ i or he or we should show if we want to use assets. Then i could use assets. He does not have that money, neither do i. His income is what he has left over, daughter money is deducted or extracted, and that makes his income nett right?

It is really sad to know your situation. Regarding your question about joint sponsor and cosponsor well here it is they are two different things but have the same purpose. Which is to help the peitioner reach the 125% poverty line. A co-sponsor (resides in the same household as the petitioner) fills out the I-864A. A joint sponsor (doesn't reside in the same household as the petitioner) fills out another I-864. But no matte what, the petitioner still needs to fill out an I-864 whether or not he or she meets the 125% poverty requirements. Now the other part what can done so that u can have a visa well like every one said your chances for getting an immigrant visa is pretty slim considering he is being a disabled person I think you should keep trying searching a job and apply for a work visa no matter what i am pretty sure you will able to get one try using this site http://www.meetup.com/

Even if you include his child support into his paycheck, that means he only gets 1670 a month which is 20070 (1670 x 12) a year which still isn't enough while he has to include his daughter as a member of the household.

Once his daughter is not considered a member of the household (someone said that child support ends at 19 in Indiana) he will ONLY make 128 over the "minimum requirement" for a household of 2.

Again though, if he only makes 128$ more than the "minimum requirement" you still run the risk of being asked for a cosponsor.


For him to meet the financial requirements RIGHT NOW he would have to make at least 2100$ a month, to support himself, his daughter and you.

He would make enough to support himself and you once his daughter is not considered a household member, but that's still years off.


Also, again, as a massive warning. Be careful when you try to "just get by" on the financial requirement, THEY CAN refuse your visa if he makes too close to the line. If they refuse it, your only option is to find a cosponsor. People have been asked for cosponsors when they made 3000$ over the limit, in your case he'll only make 128$ more than the limit, and all of his funds are federally given to him.


The closer you are to the minimum financial requirment line, the higher risk you run of being asked for a cospsonor.

No, not right.

When people are talking about gross and net income, they are talking about income before and after taxes.

Your fiancé is getting SSDI. He does not pay taxes. His gross income is the same as his net income because nothing is taxed.

Please clarify this. Does your fiancé get $1170 and then $500 is taken out for child support, thus leaving him with $670? Or is he getting $1670 and then $500 is taken out, this leaving him with $1170?
