Good day everyone!

We are desperately looking for answers regarding our situation.

I am a derivative beneficiary under the petition of my mother which was filed by my aunt under F4 category.

I'm 21 years old when my mother's notice arrived, so that means I age out. We are worried if I am eligible under CSPA or not.

Our notice for visa availability was received on October 14, 2015.

Priority Date- November 18, 1992

My Date of Birth- March 10, 1994

Your response would highly be appreciated. Thank you so much.

In the December 2015 Visa Bulletin, the current PD in the F4 category for the Philippines is July 1, 1992. Therefore, your CSPA age can not be calculated until your mother's PD becomes current. If you have the I-130 approval date, I can help you determine when the PD has to be current before you age out and CSPA can not help you.

Ao when was the approval date?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Ask your Aunt?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

You get 2 important notices when a case is filed , the first that it was accepted ( called NOA1 here on VJ) and a second when they look at it and approve it ( called NOA2) The difference between these dates is how much "younger" you are. SO if you are 21 and it took 10 years between these dates immigration see you as an 11 year old. Exact dates are important. One day over and you are aged out.

This will not be over quickly. You will not enjoy this.
