Greetings all, please help me to get over with this nightmare.


I'm a us citizen married with Cuban who came to the US with CR-1 (Spouse visa) 5 months ago. He has been ungrateful and complaining all the time for every little things. Also has been abusing me mentally and physically for several times and finally I had to report to the police. He was arrested recently and bailed out of Jill and charged with Third-Degree Assault, False Imprisonment domestic violence. Also restraining order in place, he can't contact me or come by our house till the out come of the hearing which is in a month. I have a right to remain silent or to be involved in the case. At this point I do not know what the out come going to be. I don't even know where he lives at the moment, he has no friends in town expect my fiends which he will be ashamed to go to, my guess is homeless shelter. My husband has seen a lot of violence growing up in his family and he might be affected by that. I feel very unsafe with his behavior when he gets angry and when switches his moods. It might be beyond my ability to change him and I'm afraid for my life. I have tried and tried and it didn't work. So, my question is:


1) how do I go about withdrawing my sponsorship?

2) Will he be deported if I withdraw my sponsorship?

3) If I decided to divorce him, which comes first, divorce or withdrawal sponsorship?


I'm worried and do not know how to deal with the situation, Never in my life had experienced domestic violence and it is scary. I'm trying to leave behind the financial damages and the stress over the years dealing with the immigration processes (denial of fiance visa, traveling third country to marry and continue with spouse visa), BUT worried for my life. Please advise how to deal with the situation. I can't imagine living in the same city with me as he is jealous person and can be harmful. Please advise......

1. I'm not sure, but I know one of the experts will come in here and explain it to you shortly.

2. Unless he commits a crime or runs into a deportation officer, I'm sure they are not going to actively go looking for him.

3. There is no if, you should divorce him. Growing up with domestic violence is no excuse to hit another human being in a relationship.

I am very sorry for your situation. Him being involved in domestic violence will not help him to convert CR1 to IR1 foe which he has to prove moral character and he failed to do so. Divorce time is varies state to state. There are free legal assistant available in every state you can reach them at your place. You being victim of domestic violence will get immediate help.

Also for withdrawal you can contact USCIS, but not sure if you can withdraw your financial support. May be someone from Vj Will answer you soon about it.

If you have any thread then you can contact local authorities to get protection.

divorce 7 move on., if he got here 6 mths ago you can go to infopass with police report

and show the evidence,i don't know if or what would come of it, you should be informed

that Cubans are not deported they have not addressed that issue yet with the minimal thaw

between both countries....stay safe

You CANNOT withdraw your sponsorship, he got his GC already. Divorce move on and be safe.

Abuse is a choice, there is no excuse for his behavior.Cuba does not accept people deported from the U.S. because of a criminal record, that being said he won't be deported.

Thank you Sandranj for your respond. What is the reason that I can not withdraw the sponsorship? We still have to renew together his GC with in the two years, he has been only been here 5 months. What happens when I divorce him? He can still get his GC? So if he has criminal record here he can not go back to Cuba? If people gets marry out of USA can they still do the divorce in US? I appreciate your input. Thank you

Arrested is not a conviction.

If he is convicted of a felony, then it is almost immpossible for him to get a 10 year card based on the divorce waiver.

If i were in your shoes, i'd make sure the testimony is solid enough for conviction, and then file for divorce concurrently.

With a conviction plus a divorce decree clearly stating dv, take all into an infopass appointment and talk with the FDNS officer, showing those two docs.

This is not immediate 'fix' but he won't be able to get a 10 year card, later.

You signed the I 864, you can read what it says.

My advice would be to divorce and move on. Since you didn't read what you were signing in 864, it says that it is valid until he becomes a US citizen or completes 40 quarters (10 years) of legal work.

Also, make sure you follow through with the courts in his case, don't drop the charges or miss his trial, you are the key witness, they probably can't convict him without you. If he's in jail, you can sleep knowing he can't hurt you.

Thank you all for your advice. I'm still in shock, numb, felling lost with the situation. I hope to get courage to do what I need to do next to protect myself. Your support is really appreciated.

He was arrested last night again for braking no contact restraining order (posting insulting comment on my Facebook) as I'm a public figure he is trying destroy my repetition in the town I have been living for 20 years, a town where I gained a lot of respect among my community. Now my peace is disturbed because of somebody I brought 5 month ago, he is badmouthing me and I see people pointing at me feeling sorry for him. I'm sure he didn't tell them what I did for him, what I went through emotionally and financially to bring him here. I wish immigration can consider immediate actions in domestic violence cases. Thank you again for your advise the and support over the years!
