Hello All,

My husband has filed AOS from the VWP. His EAD has been approved, he has received his Social Security card, and has just started his first job. We weren't sure how to fill out the W4 form. We read somewhere that he has to check Single even though we are married, and he can't claim our kids either? Is that correct?

He could put anything he wants down, true or not. It's just going to affect whether or not he owes or pay taxes come tax season. To do it the most accurate way possible to get a close to a zero owed/return tax during tax season it would depend on what's on yours, if you have your self and your kids, than yes he would only put himself....as you are already claiming you and the kids.

If he is the only one working, than why would he only claim himself and not you or the kids? Anyway between you and his w-4 just makes sure yourself, he, and the kids are claimed to get the least taxes taken out every month with a small end of year tax return. To get taxed to death and get a big return, don't claim anything on the w-4s.

There's no right or wrong as is all balances out during tax season.

Hello All,

My husband has filed AOS from the VWP. His EAD has been approved, he has received his Social Security card, and has just started his first job. We weren't sure how to fill out the W4 form. We read somewhere that he has to check Single even though we are married, and he can't claim our kids either? Is that correct?

The purpose of the W-4 is to withhold the correct amount of taxes so that the worker does not end up paying a penalty for underpayment when the tax return is due.

The W-4 is for the employer. It's not for the US government.

Your husband does not have to check single even though you are married. He can check married. If he checks single, more taxes will be taken out than if he check married.

A W-4 is not for claiming kids. If he includes your kids on the W4, he is increasing his personal allowance and less taxes will be withheld. If not enough is withheld, then he will owe taxes on his tax return.

My husband claimed 0 because we do not want to be short on taxes and my self employment taxes are high so claiming 0 should cover both of our taxes.

Most people don't claim all members of the household, some claim 1, it depends on the situation. You can have it checked in April when you file taxes and

change it if you want to adjust to what you need it to be.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
