Hello VJ members,

I might have a divorce soon, things are not going well. My marriage is real but things are happening, I am a conditional resident and I am living with my wife for a year now, I am collecting good faith marriage evidence, we have the following;

Joint car lease

Joint car insurance

Joint dental saving plan

Joint utilities bills

Joint Credit card

Joint phone bill

Birthday cards + welcome card from my wife and her family

Lot of photos

We have no joint bank account

Joint taxes filed as married I was claiming her and her 2 kids on my W-4

Right now we will be going to marriage counseling trying to make things work and fix the problems, plus she is going to a social worker to help her get over her emotional and mental problems.

My question is are these evidence are good enough? plus what evidence can I get from the marriage counseling? Do they write like a report or what?

To obtain any records from marriage counseling, you would both have to sign a request to release the information.

Depending on the state and your divorce attorneys. it still might be unadmissable in a court / the information can not invade the privacy of the other and if she is having mental and emotional issues as you say, her attorney may not want that disclosed as it affects ability to get driving licence and jobs in the future

As to the other, your evidence looks valid but others here can answer better than me

She left her job due to her condition, she is on medication too. Her doctor suggested that she applies for permanent disabilty because she's not able to work with how she is. I don't want the divorce I want to help her, but she is unstable at all.

Yes we have that too. I have a joint lease signed by me and her when I arrived to the US and dated by that date, our driving licenses also have the same address.

Your evidence looks fine.

However try to remember you married in sickness and in health. If your wife hasn't always been disabled it may be really hard for her to be going through the inability to do things. I suggest counselling just for yourself so you can learn how to deal with your own emotions surrounding your marriage. It's good that you're going to marriage counselling and she is also going on her own. I cannot imagine how hard it would be to not be who I am anymore because of a disability. My post-partum depression was hard enough. It would be worse if my husband suddenly decided he couldn't be with me either through such a tough time.

This is up to you of course.

I will not divorce her or leave her alone, I promised myself and her that I will stay with her and help her in everything. But I am worried about her behavior, one day she kicked me out of home for no reason, she was having kind of mental attack, next day she cried and begged me to forgive her and she didnt know what she was doing. She is very impulsive. She might file for divorce and regret it the next day or week or month. She is very unstable and she might terminate our marriage while shes in some mental condition.

She may be bi-polar. It would likely require a specific diet, exercise regime, and likely very specific medication.

Yes this is what the therapist said, he also said she might be having Borderline Personality Disorder. She is on depression pills. One day she left the house and txted me saying something like she wants to suicide, I tried to call her and reach her but she turned her phone off. I went to the police station and told them what happened so they can try to find her out and make sure she's ok, few days ago i requested the police report from them regarding what happened to keep it in my records. Do you think it's a good idea? I have no idea what's written in it.

Antidepressants wont help someone with bi-polar

Ya that's what I told her, I don't know, My life is very unstable and I feel insecure of what she might do. I know that she doesnt mean to do anything bad but I might get hurt eventually. I am trying to protect my self as much as I can.
