Form I -765

Hello,

I am a Canadian citizen ,currently I have a TN visa, (employment based) . Will the form I-131 & form I -864 affidavit of support ( being applied by my son ) and form I-485 applied by me along with G-325a and form I-693 by medical examiner are sufficient.I am planning of applying the whole package to Chicago IL office.

Also If I have to submit I- 765 what will be the correct eligibility category for section 16 of form I-765 ,

Please advise.

It sounds like you're already in the US on a TN visa and are adjusting status based on being the parent of a US citizen? Your son would need to file an I-130, not an I-131. An I-131 is an application for travel document (Advance Parole), and if you want to travel internationally during the adjustment process you should file one as part of your AOS package. Once the AOS package has been submitted, you should not leave the US until you've received your Advance Parole. Your TN is a nonimmigrant visa, and entering the US on a nonimmigrant visa when you have immigrant intent is considered visa fraud.

The eligibility category on the I-765 for someone submitting an I-765 as part of an Adjustment of Status package is c9, Adjustment Applicant.
